"I'm not aware of a successful case in Ontario involving a social host's liability." He said similar cases have been attempted but facts have not been sub­ stantiated to find the liability of social hosts (ie. persons serving drinks to acquaintances or at private parties). Bars have been found liable for serving alcohol, but not social hosts,, noted Abraham. "Juries are reluctant to find liabili­ ty because they have been in the same position themselves," said the lawyer. Abraham said the accident has posed a severe physical and financial hardship for Dryden, now 19, and his family. The delay between the accident and filing of the lawsuit is not unusu­ al, said the lawyer. "A lot of time was required to wait for the injured party to get better." Abraham confirmed defendants have claimed Dryden was not wear­ ing a seatbelt when the accident occurred. But the lawyer would not comment on the accuracy of these claims. McCaw's mother confirmed his family has also filed a lawsuit. However, she did not believe the fig­ ure was close to the $10.1 million total reported elsewhere.
