Places of amusement â€" such as bingo parlors, bowling alleys and bilâ€" liard halls â€" will be added to the byâ€" law, although Dr. Nosal says they should set aside 50% for nonâ€"smoking or provide ventilation to outside air. If all goes well, the new byâ€"laws would follow on the heels of Bill 119, the proposed Ontario Tobacco Control Act, which could be passed as early as this spring. According to Assistant Town Solicitor Doug Carr, further draft changes and amendments may still be required but will be carried out where necessary to prevent inconsisâ€" tencies. Dr. Nosal also asked that fines for nonâ€"compliance with the new byâ€"law be increased from $2,000 to $5,000. As it stands now, Bill 119 includes a provision that permits the more restrictive measure or penalty â€" whether it‘s local or provincial â€" to prevail. Said Dr. Nosal: " ... passage of a Municipal Public Places Byâ€"law that has equal or more stringent restricâ€" tions than Bill 119 can only reinforce the importance this Council places on the protection of the public‘s health." In a questionnaire sent to 405 nonâ€" retail businesses in Oakville with more than 10 employees, 61% of the respondents were in favor of a Municipal Workplace Nonâ€"smoking Byâ€"law. Of those who indicated they were not in favor of workplace restricâ€" tions, 29% do not allow smoking on their premises. A further 1,500 questionnaires were circulated in November through the BIA and Chamber of Commerce newsletters. Of those who replied, 72% of nonâ€"retail businesses were in favor of workplace smoking legislaâ€" tion. If passed, all that‘s left is to deterâ€" mine just how the new byâ€"laws will be enforced.
