Young people who break provincial laws get sharp lessons at Ontario's first 'boot camp' and we are turning many lives around as a result. There is a need for real, effective change to the federal law on young offenders including automatic adult consequences for crimes like mur­ der, manslaughter, robbery, sexual assault and drug trafficking, as well as mandatory adult sentences for crimes involving weapons and repeat offences such as break and enter. Domestic Violence Domestic violence is wrong. Plain and simple and will not be tol­ erated in Ontario. We have special courts dedicated to domestic vio­ lence cases and expanded assistance to domestic violence victims and programs. I am committed to maintaining and improving services to victims of domestic violence and doubling the number of domestic violence courts to bring cases to justice quickly and protect both victims and witnesses. Linking all shelters and rape crisis centres to the information technolo­ gy of our justice system would allow victims, support workers and police, instant access to information such as court dates, bail conditions and restraining orders. I am in favour of a 'Zero Tolerance Directive' to all police agencies to make criminal charges automatic any time someone breaks a condition of bail, parole or a restraining order. I will continue to strive to make Ontario the safest place to live and raise a family. Not only are the immediate victims affected, but so are family members and friends, the community at large, and the economy. Economically, not only are the victims and families burdened financially, but so are the enforcement, judicial and correc­ tional systems (and this is where your tax dollars come into play). As well, crimes and the percep­ tion of crime rates affect tourism and investment decisions. More important still is the physical and emotional harm, which simply cannot be mea­ sured. The Family Coalition Party believes in person­ al accountability. That means that victims' rights come first, not last, that guilty parties serve their full sentences, and that criminal records be a real factor in sentencing. Society works as a system when the vast majority understand the rules, understand why the rules make sense, and make a decision to abide by those guidelines for the common good. Where do we get people who will behave like that? We raise them. We teach them by example. We speak out when something is wrong. We give the victims more attention and support than we give the criminal. The issue here is not just major crime. There are numerous examples to show that enforcement of minor crime laws reduces major crime as well, because it sends a powerful message that anti - social behavior will not be tolerated. It should come as no surprise that it is more effective to give people this message before they are in court. We believe that respect for oneself, for others, and for their property is best learned in the home and school. For that reason, we would fund fami­ ly counseling and support services, promote moral values in schools, and establish true rehabilitation and training programs in the correctional system . The subject in question is how a step patent stands in place of a parent in terms o f potential child support payable by either, in the event of a separation. Under the new Child Support Guidelines, which came into effect May 1, 1997, support is payable by a non-custodial "parent" based on his or her gross income. This base amount o f child support is neither deductible to the payor nor is it indudable in the recipient's income. The problem arises is where there is a natural lather, for exam­ ple, and a step father. Section 33(71 o f the Fomihi Low A tp ro- videsthar, an Older for the support o f a child should, a) recognize that each parent has an obligation to provide support for the child; b) apportion the obligation according to the Child Support Guidelines A step parent will be liable for child support if he or she stands "in loco parentis" or in other words, attend to the child's physi­ cal, emotional and other needs and otherwise acts as a parent. When ordering a step parent to pay child support, the Court is not bound by the Child Support Guidelines, but has a discre­ tion to make a support Order that is "appropriate." A number o f recent cases have intentionally ignored this when ordering a step parent to pay child support. For example, in one case, where the natural father never paid any child support and did not see his children for ten(10) years, the mother cohabitat- ed for five (5) years with another man who was a step parent to two (2) children, the Court found that the step parent had to pay the stria guideline amount according to his gross income. This was no different from what a natural parent would have paid. However, the Courts have not been consistent in the manna in which they are ordering child support payable by a step par­ ent The only relief is that there is some case law where the Courts have ordered time limited child support for step parents, afta which time their obligation stops. Due to the obligations step patents have to pay child support, should they also have the same rights as a "parent" while they are residing with the child as custodial parent?
