The dispute is over Shorewood Estates, the site of a future 18-lot subdivision on the property once owned by the Hindmarsh family. Ruth Anne Winter, granddaughter of Ruth Atkinson Hindmarsh, former owner of the property, maintains that the family's original draft plan of subdivision took pains to save most of the site's arboreal gifts. After the land was sold about a year ago, Winter says a modified scheme required the removal of trees which she believes should have remained. Town Forestry Manager John McNeil, however, stands by the altered design which he says actually improves upon the original. The trees on-site include red oak, sugar maple, black cher­ ry, blue spmce and white pine. Several years ago lawyer Blair Taylor was retained by Winter's family to devise a draft plan of subdivision to create 18 lots on two pieces of property which at that time was still owned by the Hindmarshes. Among Taylor's team of consul­ tants was Cam Kitchen, president of Ecoplans Ltd., a leader in his field who addressed the tree issues. This included a cul de sac, no sidewalks and, in short, an environmentally friendly landscape from top to bot­ tom. "This was designed in a tasteful and sensitive manner with a sense of tradition and history," said Taylor, who explained that the concept was in keeping with existing zoning. Winter agrees and says that unlike other lakeshore estates which have essentially been clear-cut, her family wanted their property to retain as much of its character and integrity as pos­ sible. "We fought a long and costly battle to save this place," she said. The original draft plan was approved with specific condi­ tions in regard to all the trees. There were even provisions to educate future homeowners about the best place to position their new houses and how to care for the southern woodlot. The property was sold by the family about a year ago to Tyba Properties of Toronto. McNeil explained that the plan worked out with the devel­ oper took pains to preserve trees, especially those in the wood- lots down the east side of the property and at its bottom by the lake. Since the development of Glen Abbey, he said, the Town has made a conscious effort to maintain larger, continuous swaths of green whenever possible. According to John Ghent, the Town's Manager of Current Planning, the original plan has not changed. Under the new plan the road remains in the same position, as do the lots. It also ensures the preservation of the lakeside woodlot but pushes the house sites closer to the centre road, in effect stretching the rear yard. This moves the homes away from the trees to avoid dam­ aging their roots. The plan also places restrictions on the lakeside backyards to preserve the woodlot and the integrity of the public trail sys­ tem there. (Access would be alongside Lot 10.) This includes such provisions as not allowing private gates. McNeil said the developer was reluctant to make the changes but the Town stood firm. Ghent maintains that both plans tried to save as many trees as possible but differ slightly in how to achieve that objective.
