A post-mortem examination deter- mined the worker died of inert gas as- phyxiation. There were no eye witnesses to the in- cident. The victim was described as an experi- enced worker. The Ministry of Labour noted nitrogen displaces oxygen and can be an asphyxia- tion hazard in an enclosed space. They also pointed out that neither worker was required to enter the tank to complete the wash. Prokleen Washing Services pleaded guilty and justice of the peace Margot McLeod fined the Oakville company $105,000 in Milton court. The court also imposed a 25 per cent victim fine surcharge as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist vic- tims of crime.
