Dennis (Dinesh) Khan- na, 64, is also ordered to do 80 hours of community ser- vice in the next nine months. In avoiding a jail sen- tence on Thursday, Khan- na, an Oakville resident, called his trial a waste of taxpayer money and main- tained to The Spectator that he is not guilty. It's true he was found not guilty on a fraud charge and acquitted of three sex- ual assault charges. However, he was found guilty of three other sexual assault charges. Moments earlier, Jus- tice James Ramsay said the sexual assaults, although categorized as less serious by Khanna's lawyer John Rosen, "have serious dam- aging effects, and they can- not be taken lightly." The charges Ramsay found Khanna guilty of onfound Khanna guilty of onf Feb. 19 included kissing a woman on her Hamilton porch as she cried and told him about the death of her mother and marriage breakdown, which meant she was unable to make the mortgage payments she owed him. Court heard Khanna told her she could "perform favours" for him if she was short of money. Ramsay also found Khanna guilty of two counts of sexual assault on another victim, a tenant in one of his Hamilton rental houses. He smacked her buttocks on one occasion while making comments that she looked good. On another occasion, he touched her breast under the guise of reaching out to her baby in her arms. Ramsay agreed with Crown prosecutor Fraser McCracken that Khanna was in a position of power over these two women "and he took advantage of that." Court heard Khanna specialized in subprime lending and his clients struggled financially. Many went to him for sec- ond mortgages and consol- idated loans they couldn't get elsewhere. McCracken urged Ram- say to give Khanna a six- month jail term. Rosen ar- gued for a suspended sen- tence. Although Ramsay went with a suspended sentence, he noted Khanna "will be branded a sexual offender and is required to report and register as a sexual of- fender for the rest of hisfender for the rest of hisf life." His DNA will be col- lected and put into the reg- istry databank. He noted Khanna lost his mortgage broker li- cence and business, and will never get them back, for which he has only him-for which he has only him-f self to blame. "It's pretty clear that he has lost everything except his family," Ramsay said. "Certainly, given what he's done, he deserves a come- uppance. But he has had one; he's had a serious comeuppance." The judge said he was giving Khanna a suspend- ed sentence because of his age, health (a heart condi- tion) and the other conse- quences he's faced because of his bad behaviour.
