These measures, which ClubLink appealed to the Ontario Superior Court of Justice, aimed at restricting what could be built at the golf course. It regulated the erection, location and use of build- ings and structures to en- sure the heritage attributes of the site were retained. In his Dec. 11, 2018 deci- sion Superior Court Justice Morgan appeared to agree with ClubLink that these measures were too restric- tive and ruled the conserva- tion plan and the related by- laws were invalid. Oakville council then voted unanimously on Jan. 7, 2019 to appeal this deci- sion to the Court of Appeal for Ontario.for Ontario.f In handing down her de- cision Justice Harvison Young expressed many of the same concerns as Jus- tice Morgan. "The conservation plan regulates Glen Abbey to such a degree that it has the effect of compelling the pro- vision of the service of oper- ating a golf course," she said. "In order to comply with the conservation plan, Clu- bLink has no practicable op- tion but to continue to oper- ate the golf course as it cur- rently is and minor changes to its course are subjected to town approval."
