We work for you. legal matters Q A REAL ESTATE LAW What happens if a vendor doesn't want to sell? If you have bought a property and the agreement of purchase and sale is firm (ie: not awaiting the fulfillment or waiving of any conditions), then a vendor who wishes to back out of the deal would be doing so at substantial risk. As a purchaser, you would have the right to sue for specific performance and damages. Specific performance means performance of the contract. In this instance, it would be the transfer of the property for the agreed upon amount. Obtaining an order for specific performance depends on the type of property being bought. If you can make a case that the specific features of the property are particularly attractive to you and that monetary damages could not adequately compensate you for the loss of the property, then you would have a good case. In addition, you could register a certificate of pending litigation against the property to ensure that the vendor does not sell to anyone else in the meantime. Local children will soon be able to enjoy a new playground that's almost done at the Gellert Community Centre on Eighth Line in Georgetown. JUST THE FACTS • The new playground includes junior and senior play equipment, a zip line, swings, spinning net climber, activity pan- els, music area and other inclusive fea- tures. Stepping pods and a balance beam connect the play equipment. • After receiving public feedback, the Town added more swings, an expanded ju- nior play structure and a greater diversity of play features to the plans. • While the playground was initially slat- ed for construction in the spring, the pan- demic has set the project behind schedule. Some parts required to complete the play- ground have been delayed due to COVID-19. • Currently, Town staff's best estimate for the playground's completion is early September. The municipality is communi- cating with the contractor on the timing of the delayed parts. • The project has a budget of $200,000. NEWS WHAT'S GOING ON HERE?
