and where domestic animals or birds are kept for treatment service station 23 aotomofaue service station shall mean a builolng or place where gasoline oil grease astifreese tires tabes tire accessories electric tight faolbs sparkplugs and batteries for motor vehicles are stored or kept tor sale or where motor vehicles may be ailed greased or washed or have their ignition adjusted tires inflated or batteries charged or where only minor or run ning repairs essential to the actual operation at motor vehicles are executed or performed aulouhjtl trade ia automotive trade shall mean a use residential zone a building containing one or more dwelling units shall be deemed to be a main building on the lot on wmcb it is situated business office 29 baafaess office shall mean any building or part of a buudbgg in which one or more persons are employed in the management direction or con ducting of any agency business brokerage or labour organization and shall include a telegraph office newspaper plant and a radio or television broadcasting station stodto ox theatre car washing establishment 210 car washing estatsbmeot shall mean a bsudtag exdaatvery intended for washing or clean ing motor vehicles lor gain cfaarch 211 church shall mean a building dedicated to reuglou worship and may incbjde bandar t schools clinic 212 clinic shall mean a balking in wide i pub lic or private meoleal surgical pbysiotheri nestle or other services related to human heal h are provided except where these services are acces sory to a public or private hospital commercial school 213 commercial school shall mean a school conducted tor the purpose of economic gain other than a private academic or religious school and includes the studio of a dancing or music teacher an art school a golf school a school of calis thenics a business or trade school and any other such specialized school conducted for economic gain commercial garage 214 commercial garage shall mean a building in which major repairs are carried out on motor vehicles community hall 215 community hall shall mean a premises offered for use or used asaplace of public assem bly or where the premises are offered for hire or where a fee is charged or a collection made for the entrance entertainment or otherwise but shall not include premises used solely for religious purposes nor a theatre within the meaning of the theatres and cinematographs act corporation 216 corporation shall mean the corporation of the town of acton council 217 council shall mean the council of the corporation of the town of acton custom workshop 218 custom workshop shall mean a building where there is carried on lndrrtaual custom pro duction of drapes and slip coversyvenetian blinds handmade leather goods millinery glass blow ing orthopaedic and prosthetic appliances drug and medical prescriptions weaving awnings met al plating gold and silver engraving and other nonoffensive nondangerous custom production of any article or thing but does not include any factory production or any shop or factory other wise classified or defined in this bylaw department store 219 department store shall mean the use of an enclosed building in which various types of com modities are kept for retail sale in separate parts of the one building on two or more floors dwelling or dwelling unit 220 dwelling or dwelling unit shall mean a separate set of living premises designated for occupancy by one family for living and sleeping purposes but does not include a hotel or board ing or lodging house dwelling apartment 221 dwelling apartment shall mean a separate building containing more than four 4 dwelling units and shall not inemde a multipleattached dwelling dwelling duplex 222 dwelling duplex shall mean the whole of a two storey building divided horizontally into two separate dwelling units each of which has an in dependent entrance dwelling double duplex 222 dwelling double duplex shall mean two attached duplex dwellings dwelling detached 224 dwelling detached shall mean the whole of a building containing one dwelling unit only dwelling semi detached 225 dwelling semidetached shall mean the whole of a building divided vertically into two sep arate dwelling units dwelling ifultiple attacbed c 226 dwelling multiple attacbed or rowhousing shall mean a building containing not less than three noncommunicating one or two storey one- family dwelling units divided vertically having a common wall between each two adjacent dwelling tints dwelling unit area 221 dwelling unit area shall mean the floor area of a dwelling unit measured to include all the walls of the dwelling unit eating establishment 226 eating establishment shall mean a building or part of a building where food is prepared and offered for sale or sold to the public for immed iate consumption therein but not including the preparation of food for use away from the prem ises and includes a restaurant cafe tea or lunch room dairy bar and refreshment room or stand but does not include a boarding or lodging house erect 229 erect shall mean with reference to a building or structure construct build or assem ble and shall include enlargement relocation and any physical operations preparatory to construct ion or reconstruction established grade 230 established grade shall mean the average elevation of the finished grade adjoining the front wall of a building exclusive of any embankment in lieu of steps and tbta commercial district 1 shall mean the average elevation of the sidewalk in front of the lot on which the building stands existing 231 existing shall mean existing as of the date of the passing of this bylaw family 232 family shall mean one person or two or more persons who are interrelated by bonds of consanguinity marriage or legal adoption or a group of persons occupying with or without one or more domestic servants a dwelling unit first floor 233 first floor shall mean the floor of a build ing approximately at or immediately above the established grade floor area 234 floor area shall mean the total floor space on one or more floors contained within and inclu ding all the walls of a building or structure and excluding any basement or cellar and in the case of a dwelling excluding any porch verandah sun- room or private garage fuel storage 235 fuel storage shall mean a tank for the bulk storage of petroleum gasoline fuel oil gas or inflammable liquid or fluid but does not include a container for inflammable liquid or fluid legally and properly kept in a retail store or tank for storage merely incidental to some other use of the premises where such tank is located garage private 236 garage private shall mean a oullolug or part thereof including a carport used for the stor age of a private passenger motor vehicle but not a commercial vehicle and wherein servicing for profit is not conducted ground floor area 237 ground floor area shall mean the area of that portion of a lot occupied by a building or structure exclusive of any verandah porch sun- room or private garage home occupation 238 home occupation shall mean any use cus tomarily conducted entirely within a dwelling and carried on by inhabitants thereof which use is clearly incidental and secondary to the use of the dwelling purpose and does not change the charact er thereof or have any exterior evidence of such secondary use there shall be no display no stock in trade no commodity sold upon the prem ises no person employed except such as is nec essary for housekeeping purposes it shall include the office of a dentist physician chiropractor or chiropodist but a clinic a hospital a barbershop a beauty parlor a tea room and an animal hospit al shall not be deemed home occupations half storey 239 half storey shall mean that portion of a building situated within the root or having its floor level not lower than four 4 feet below the line where the roof and outer walls meet and having a roof not steeper than fiftyfive degrees above the horizontal hereafter 240 hereafter shall mean after the date of the passing of this bylaw herein 241 herein shall mean in this bylaw and shall not be limited to any particular section of this bylaw hotel 242 hotel shall mean a building or part of a building which contains a general kitchen a dining room and other rooms open to the public which may include a tavern or public house as defined in section 272 and the remaining rooms of which lot coverage maximum 50 height maximum 50 ft front yard minimum 20 ft except where any industrial ml zone abuts any residential zcoe or is separated from any residential zone by a street or lane only then a front yard of 40 feet shall be required on the front that abuts or faces side yard minimum 20 ft except where any industrial ml zone abuts any residential zone or is separated from any residsntliq zone by a street or lane only then a side yard of 30 feet shall be required on the side that abuts rear yard minimum 25 ft except where any industrial ml zone abuts any residential zone or is separated from any residential zone by a street or lane only then a rear yard of 50 feet shall be required on the rear that abuts offstreet parking requirements see sections 517 and 518 offstreet loading requirementssee section 519 82 industrial general u2 zone 821 permitted uses all uses permitted in the ml zone and all manu facturing and industrial uses a transport term inal a builders depot an automotive trade yard storage including fuel storage a commercial gar age including body and fender repairs a business office an eating establishment and uses accessory to the foregoing 822 zone requirements lot area minimum nil lot frontagj minimum nil lot coverage maximum 66 height maximum 35 ft front yard minimum 50 ft except where an industrial m2 zone is oppo site to any residential zone or is separated from any residential zone by a street or lane only tbei a front yard of 75 feet shall be re quired on the front that abuts or faces side yard minimum 20 ft except where any industrial m2 zone abuts any residential zone by a street or lane only then a side yard of 50 feet shall be required on the side that abuts rear yard minimum 25 ft except where any industrial m2 zone abuts any other zone or is separated from any other zone by a street or lane only then a rear yard of 50 feet shall be required on the rear that abuts offstreet parking requirements see section 517 and 518 offstreet loading requirementssee section 519 22 zone requirements minimum distance of buildings or structures from any lot line shall be 30 feet except where a lot line abuts a lake or river when no yard shall be required on the side that so abuts section 10 rural a zone in any rural a zone no person shall use any building structure or land nor erect any building or structure ex cept in accordance with the following provisions 101 permitted uses all uses permitted in the 01 and 02 zones subject t o the requirements thereof and the following all agricultural uses an openair farmers mar ket a golfdriving range a miniature golf course an archery range a private club a kennel and a dwelling as an accessory use 102 zone requirements agricultural and open space minimum distance of buildings or structures may minimum distance of buildings or structures from any lot line shall be 30 ft except where a lot line abuts a lake or river no yard shall be required on the side that so abuts requirements for dwellings as an accessory use lot area minimum lot frontage minimum lot coverage maximum height maximum front yard minimum rear yard minimum side yard minimum floor area minimum 15000 sq ft 100 ft 20 35 ft 30 ft 35 ft 10 ft 900 sqft section 11 administration 111 zoning administration t this bylaw shall be administered by a person designated from time to time by the council as the zoning administrator 1u violation of this bylaw where land is proposed to be used or a building or structure is proposed to be erected or used in violation of this bylaw no permit for the use of the land or for the erection or use of the building or structure shall be issued 113 application and plans section 9 open space zones in any open space zone no person shall use any building structure or land nor erect any building or structure ex cept in accordance with the following provisions 91 open space parks 01 zone 911 permitted uses a park a playground a playing field a flower garden a community hall an open or enclosed swimming pool a bowling green a tennis court and a refreshment pavilion or booth and parking facilities accessory to any of the foregoing uses 912 zone requirements minimum distances of buildings or structures from any lot line shall be 30 feet lot coverage by building and structures maximum 20 92 open space conservation 02 zone 921 permitted uses all uses permitted in the 01 zone subject to the requirements thereof and the following a farm a market garden a nursery a golf course a cemetery a sewage disposal plant a water works a municipal yard forestry or activity con nected with the conservation of soil or wildlife and a building or structure accessory to the foregoing uses in addition to the requirements of the building by law every application for a building permit shall be accompanied by plans in triplicate drawn to an appropriate scale based upon an actual survey showing the true shape and dimensions of the lot to be used which it is proposedtoerect any build ing or structure and showing the proposed loca tion height and dimensions of the building or structure or work in respect of which the permit is applied for and the location of every building or structure already erected on or partly on such lot together with a block plan and a statement signed by the owner or his agent duly authorized there unto in writing filed with the zoning administrat or such statement shall set forth in detail the current and intended use of each building and the structure or part thereof and all information nec essary to determine whether or not every such building and structure conforms with the afore said requirements of this bylaw 114 penalty every person who contravenes this bylaw is guilty of an offence and liable upon summary conviction to a penalty not exceeding three hund red dollars 30000 exclusive of costs and the provision of subsection 2 of section 482 of the municipal act shall apply to the said penalty 1l5 inspection of land buildings or structures the authority from time to time having jurisdic tion to enforce this bylaw is hereby authorized after appropriate notice to enter at all reasonable hours or purposes of inspection upon any prop erty or premises
