at tuesdays meeting of council mr hinton docs not sit on this committee mr hinton said that the mallin situation on elmore drive was a perfect example of subdivided doing what they want in acton he deplored the fact the ditch on elmore ran on private property and that four houses were built on the highway whether they had j righttoornot- he said it created on unsafe highway situation as well as broviding a cheap house to build they built the foundation on the ground and tilled dittup around it he said creating ai drainage problem mr mallin appeared at a tccent committee meeting complaining the construction at the rcqrol his property caused fresh soil to wash into the ditch and it was now half full of silt when the water runs rapidly it spreads over the mallin lot the committee told mr mallin they were waiting a report from the engineer on the situation and still must receive approval from the department of highways after this was obtained the clerk was to check with the builder at the rear of the mallin property for a temporary alleviation of the situation mr hinton charged that the subdividcr put the drainage in the properties and that there was nothing in tho deedjto say that the town has an easement to put a ditch in there clerk jack mcgcachic said it was not a ditch but a natural water course we knew the houses were there said councillor dyinkwaltcr we should have acted three five or ten years ago not now the committee of the whole chairman bill williams said the reeve was also there when- tltc area was inspected and had the opportunity to register any objections at that time councillor ted tyler said mr mallin knew the stream was there when he bought the house but mr hinton said council was aware of it arid shouldhave done somcthii about il councillor tyler charter in a historymaking meeting thursday evening september 4 the continuing congregation of the 1 30ycorold church on the hill formally accepted a new charter giving official recognition and renaming it churchill community church with smith griffin jr in the chair and solicitor charles leatherland giving specialized advice the meeting was guided through a maze of necessary legal technicalities and an election of officers the new church is not to be patterned specifically on any established church but is to he interdenominational in nature so that it can be said to be a truly community church the elders with the help of the minister robert hyde were given the monumental task of researching and setting down these guide lines mr hyde was complimented for his excellent leadership and his enthusiastic efforts on behalf of the church dr leslie nott of hamilton u c conference hearing of the official reestablishment of churchill as community church offered congratulations and his prayers for the future success of a congregation that has always held his special affection smith griffin newlyelected clerk of session stated i think there is a definite need in the community for an interdenominational church we realize that we arc going to have to make a lot of changes in our thinking to keep up with the changing times we would like to think we have the sayvif we don move the ditch he will take legal action replied councillor tyler the other man says if we move it he will take legal actionj the reeve was also critical of the handling of the drainage situation on cobble hihfttiad tiling the ditch from ihetop of the road is the most ridiculous thing i ever heard of ik said committee decided to start at the fourth house from the cemetery entrance and to tile from there to ihe cemetery entrance and down ihe road- to an existing manhole on cobble hill monex construction was to pay the cost of the tile manhole and catch basin arid the town work force would do the construction from the fourth house westward an open ditch is to be created to take water from the high spots further work on the north side of cobble hill road would be halted until the job was completed the reeve complained that it was written in the deed that the subdivide must put a ditch along the property line sufficient to carry all the water along the road if we do any work there which we have no right to do were wrong we still wont be able to cope with the water theres a real lake there said the reeve and it could all be drained into the swamp wouldnt you say the creek bed was better natural drainage than the swamp asked councillor tyler homeowners along cobble hill road would not want an open ditch of the size youre speaking of mr hinton replied that he wanted no 2 committee to be fully aware that he disagreed with their solution tile wont do the job he declared if you put an open ditch in it will overflow mrs coopers house said councillor tyler councillor drinkwalter asked the reeve what authority he spoke with and the reeve replied that as a layman he could see it was wrong you think youre going to tell us what to do instead of what the engineer recommends asked mr drinkwalter 1 thats the case theres no use hiring an engineer he defended the committees action mr hinlon said he was only trying to be constructive he felt that one catch basin in the middle of ihe lake was not the proper- solution lie suggested the lake be drained into the swamp councillor mckerizie asked mr hiniori why ho delayed these views- until- regular council meeting he felt the reeve had plenty of opportunity to tell no 2 corimtittee before this is there no way he asked that anyone with strong opinions like this could get to the committee before a regular meeting mr hinton replied the only way to do it would be to see the minutes and despite claims by mr mckenzie that lie still had plenty of time the reeve declared the place to do it was at council minutes of committee meetings are issued to council in advance of ihe regular meeting isnt it still rather late councillor mckenzie asked nonot for me said the reeve mayor duby said the item was a committee consideration and they should be the ones to deal with it he reminded council that there was not only cobble hill road and elmore drive to deal with but at least a dozen places in acton where flooding was prevalent during intense rain i can name hundreds of houses in town that are in a depression the mayor tald the committee is supported by the engineer and doing the best job they can they cant do any better than this he stated mr duby felt that the complaints were the reeves personal problems and that councillors should not let one individuals views dominate the discussion deputycreeve frank oakes concluded the discussion by observing that an abnormal storm- liad created an abnormal situation flic discussion has arisen since then lie said i didnt hear too litany
