acquittal on a charge of causing an in jury to 16yearold kenneth rusk by discharging a ahotflun at a motor vehicle on june 18th he had elected trial by a judge in a higher court rusk who lives in the hornby area near the accused said that at about 150 a in on june 16th he and victor jakaitis a neigh bor had started out in the lat ters car to look for their bro thers who had gone to a ball game in oraagh the previous evening and who had not return ed home they were proceeding op the eighth line and drove into the driveway of a brpther of the accused who lives near by in order to turn around they then noticed him standing in the road with a gun he had just stopped another car driven by rusks father the witness said he stopped us and told us to identify ourselves rusk told the court i was getting ready to get out of the car ja kaitis started it ihacu8ed4 1 shot the door was open i felt something hit the side of my hand i looked and there was blood coming out 1 got out and walked back to where he was he was standing the e telling his wife to phone the police rusk said that previous to being ordered to stop he and jakaitis had been shining a flashlight on the roadside ditch in order to see if their broth ers were hiding there jakaitis said the pellets from the shotgun had done about 50 worth of damage to the cars upholstery constable dennis kaye who investigated the incident said the gun was unloaded when he examined it and he found an empty shotgun shell by the side of the road he said the skin of rusk a right hand was ripped and bleeding there were chips in the paint on the right hand side of the car and a chip in the steering wheel and five notes in the ins de right door panel a fragment of lead was taken from one hold rusk was taken to millon dis trict hospital where
