AN ORDINANCE providing for the issuance of bonds of the Village of Wtlmette, to the amount of Fifty thousand ($50,000.00) Dollars, for the purpose of obtalnin~ funds wherewith to purchase land for a slte for an incinerator plant and to purchase, construct, erect and install on sald site when acquired, an incinerator plant with the appurtenances, for the use of the inhabitants of the Village of WJlll\ette, to burn, consume and dispose of garbage, refuse and waste materials for the better protection of the l}ealth of the inhabitants of said Village, and providing for the levy and collection of a direct annual tax to pay the interest and the principal of said bonds, and fixing the other details of the issue. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF WILMETTE: Section 1: That for the purpose of providing the necessary funds to purchase and acquire land for a site for an incinerator plant, and to purchase, construct, erect and install on said site, when acquired, an incinerator plant with the appurtenances, for the use of the inhabitants of the Village of Wilmette to burn, consume and dispose of garbage, refuse and waste materials for the better protection of the health of the inhabitants of said Village, there shall be borrowed on the credit of the Village, the sum of Fifty thousand ($50,000.00) Dollars, and to evidence such loan there shall be, and there is hereby ordered and directed to be is:o:ued the negotiable coupon bonds of said Village of Wilmette to said amount. Said bonds shall be one hundred (100) in number, numbered from 1 to 100 inclusive, and of the denomination of Five Hundred ($500.00) Dollars each. Said bonds shall bear date of Octoher l~t. A. D. 1928, and shall become due . ,d payable as follows: · Bonds numbered 1, 2, 3, 4, 5 and 6, aggregating $3,000.00 in amount, on Octobet· lf't, 1933. Bonds numbered 7, 8, 9, 10, 11 and 12, aggregating- $3,000.00 in amount, on Octobf'r 1st, 1934. Bonds numbered 13, 14, 15, 16, 17 and 18, aggregating $3,000.00 in amount, on October l!'it, 1935. Bonds numbered 19, 20, 21, 22, 23 and 24, aggregating $3,000.00 in amount, on Octobe 1st, 1936. Bonds numbered 25. 26, 27, 28, 29 and 30, aggregating $3,000.00 in amount, on October 1st, 1937. Bonds numbered 67, 68, 69, 70, 71 and 72, aggregating $3.000.00 in amount, on October 1st, 1944. Bonds numbered 73, 74, 75, 76, 77 and 78, aggregating $3,000.00 in amount, on October 1st, 1945. Bonds numbered 79, 80, 81, 82, 83 and 84, aggregating $3,000.00 in amount, on October 1st, 1946. . Bonds numbered 85, 86, 87. 88, 89, 90, 91 and 92, aggregating $4,000.00 in amount, on October 1st, 1947. Bonds number~d 93, 94, 95, 96, 97, 98, 99 and 100. aggregating $4,000.00 in amount, on October 1st, 1948. Said bonds shall bear interest from and after date at the rate of four and onehalf (41h%) per centum per annum, payable semi-annually, on the first day of April and October in each year, which interest installments shall be evidenced by proper coupons attached to each bond ; anrl both principal and interest shall be payable in lawful money of the United States of America at the office of the Treasurer of said Village of Wilmette, in said Village. D. 19 .... , together with interest on said sum from the date hereof until paid, at the rate of four and one-half (41h%) Per · centum per annum, payable semiannually, on the tlrst day of April and October of ~ach year, as evidenced by and upon the presentation and surrender of the interest cou_!)ons hereto attached as they severally become due ; both principal and interest payable at the offlce of the Treasurer of said Village of Wilmette in said Village, and for the · prompt payment .of this bond, with interest. as aforesaid, at maturity, the full faith, credit and resources of said Village are hereby irrevocably pledged. This bond is issued by said Village for the purpose of providing the necessary funds to purchase and acquire land for a site for an incinerator plant and to purchase, construct, erect and install on said site when acquired, an incinerator plant with the appurtenances for the use of the inhabitants of the Village of Wilmette to burn, consume and dispose of garbage, refuse and waste materials for the better protection of the health of the inhabitants of said Village, and in ac-. cordance with the provisions of an ordinance duly passed by the President and Board of Trust~es of said Village on the day of A. D. 1928 and submitt~d to and approved by the voters of Raid Village at an election duly called and held for that purpose, and pursuant to and in compliance with the provisions of an Act of the General Assembly of the State of Illinois, entitled "An Act to provide for the incorporation of citiP.s and villages," approved April lOth, 1872, and all acts amendatory thereof and supplemental thereto. And it is hereby certified and recited that all things, acts and conditions required by the laws and constitution of the State of Illinois, to happen and be done and performed precedent to and in the issuance of this bond have happened and been properly done and performed in regular and due form as required by law; and that the total indebtedness of said Village, including this bond does not exceed any constitutional or statutory limitations and that provision has been made for the collection of a direct annual tax in. addition to all other taxes on all of the taxable property in said village sufficient in amount to pay the interest hereon as the same falls due and to discharge the principal hereof at maturity. For the year 1945 a tax sufficient to produce the sum of $3495.00 being $495.00 for interest and $3000.00 for principal. For the year 1946 a tax sufflcient to pt·oduce the sum of $4360.00 being $360.00 for interest and $4000.00 for principal. For the year 1947 a tax sufficient to produce .the sum of $4180.00 being $180.00 for interest and $4000.00 for principal. And the Village Clerk of the Village of Wilmette is hereby directed forthwith to file a certified copy of this ordinance with the County Clerk of Cook County, Illinois to the end that said· County Clerk may ·in each of said years, 1928 to 1947 inclusive. in accordance with the duties imposed upon him by law, ascertain the rate per centum required to produce the aggregate tax hereinabove levied for each year and extend the same for collection upon '..h e tax rolls in connection with the taxeb lt:vied in such year by said Village for general village purposes. · And in each of &aid years, 1928 to 1947 both inclusive, the taxes hereinabove levied shall be collected by the same officers, at the ' same time, and in the ~arne manner as the taxes levied by the eaid VIllage for gene~al purposes for Ruch years are collected, and when col· lected shall be placed In a special fund and used solely for the purpose of paying the Interest on and principal of the bonds hereby authorized when and as the same mature. · Seelon 5: That when properly executed as aforesaid, sald bonds shall be dellvered by the Treasurer of said Vlllage to the purchasers of the same from the President of the Board of Trustees of said Village at not less than par and the proceeds derived therefrom shall be used solely for the puropse for which said bonds recite they are issued. Seetloa 8: That all ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same are hereby repealed. Section 7: This ordinance shall be ln force from and after its passage, publication and approval by the voters of said Village.
