The decision upholds the power of a city to determine in what manner dangerous grade crossings within its limit s shall be protected, according to the legal department of the American Motorit3ts Association, in co-operation with The Automobile Club of Illinois. The ordinance involved in the decision was passed by ~he city of Memphis, Tenn., forty years ago and required the presence of flagmen swinging flags in daytime, and lighted tanterns in the night time at all railroad crossings. Without regard for the nrdinance, one railroad company removerl it'3 crossing watchmen and substituted in their places modern mechanical sig naling apparatus. An autoist was killed at oile of the crossings and the carrier's violation of the ordinance was urged as the proximate cause of the accident. . One of the officials of the Chicago firm, however, has disclosed that Hupmobile will provide some ultra-modern touches to this driveway and will shortly make an important announcement with reference to Hupp's marked interest in commercial aviation.
