The inhabitants of these towns or cities are limited, however, to one or the other of the modes provided In . these statutes, and cannot commence proceedings under both systems. The provisions of sections 2382, 2383, 1384 and 2385 were originally embodied in the acts^of Congress off July 1, 1864, and March's, 1865; those of section* 3387.2388 and 2389 in the act of March 3,1867, Section 2394 is a re-enactment Of the act of June 8, 1868. It has ref erence t04»ees where the inhabitants Of cities or towns proceeded to act ander the provisions of the acts of July 1,1864, and March 3,1863^prior to June 22.1874, the date of the Revised uiiu in Vv'i i icl i t l icjT ' t»Vw pftri ly proved up and paid for the lots claimed by them according to the said acts. It provides for extending the - privilege of sections 2387, 2388 and 2389, if the town authorities in any such case should elect to proceed under them, to such of the inhabitants may not have paid for their lots, with- •nt interfering with the issnlng of patents to those who had made for nigh: make entries or elect to pro- eeed under the acts of July 1,1864 and March 3,1805, or sections 2382, 2383, 1884 and 2385 of the Revised Statutes. Accordingly, should any case be pre sented where proceedings had been commenced, as aforesaid, by the In habitants of any city or town before the date indicated, and a part of them not having entered and paid for their lots, desire to take advantage of the •jstem referred to, they would be en titled under section 2394 on applies tlon to the register and receiver of the proper district office,^through the town authorities, pursuant to the provisions of sections 2387. 2388 and 2389, to enter or die upon sush portion of the town site has not already been entered and paid for. and is not in the possession of parties electing to complete their titles under the original proceedings; after which that portion of the town site so entered and Hied upon will be disposed of under the last mentioned sections, and the reinaing portion, If any, under sections 2382,2383,2384, and £385. Section 2.394 has no reference 1(0any case In which proceedings for acquiring title to the town site were commenced subsequent to June 1874, the inhabitants in all such cases being restricted to the method of ac quiring title according to which they may have commenced to act. Section 2394 further provide! that, in addition to the minimum price of the lands included in any town site ; entered under its provisions, and those of sections 2387, 2388. and 2389, there •hall be paid by the parties availing themselves thereof all costs of survey Ing and platting any such town site, and expenses incident thereto Incurred by the United States, before any pat ent th^-efor shall issue. Hence, when It is desired to enter a town site found upon the unsurveyed public lands, a written application should be pre sented to the surveyor genernl of the proper district for a survey of the same under section 2401 of the Revised Statutes, and the amount estimated by him as sufficient to cover the said cost and expenses deposited with any Af- flstant United States Treasurer or .designated depository in favor of the /tFn4tefl 8tates Treasurer, to be passed .o the credit of* the fund created by 'Individual Depositors for the survey f the Public Lauds," the depositor taking a duplicate certificate of depot* ilt, one to be Hied with the surveyor general to be sent to the General Land ;Ofllce, and the other retained by the depositor.
