Grounds For Divorce Number Eleven In Illinois Illinois law devotes an entire chapter to the provisions for a legal marriage within the state, but, recognizing the human element, it allocates equal space to the subject of divorce. The case in point: While more than 125,000 marriages took place in Illinois in 1970, more than 30,000 divorces were granted that same year. Interestingly as many as 97 percent of the divorces in the state are uncontested. Because of this, most marital set­ tlements are made by mutual agreement of the parties in­ volved instead of the courts. There are eleven grounds for divorce in Illinois, the most recent addition, in 1967, being "mental cruelty" which is currently the most common charge. A party can file for a divorce if either husband or wife was at the time of marriage and continued to be naturally im­ potent; if either party had a spouse living at the time of the marriage or if either party has committed adultery sub­ sequent to the marriage. Wilful desertion for the space of one year, habitual drunkenness (for a period of more than two years) and gross and confirmed habits caused by drug addiction are all causes for divorce. Other grounds include ex­ treme and repeated physical or mental cruelty, donviction of either party of a felony t?r other infamous crime, infecting the other with a communicable venereal disease and malicious attempt at murdering the other * spouse. Before the addition of mental cruelty to the causes leading to a divorce, phj^sieaFcruelty was the most frequent grounds called upon because only two acts of physical violence resulting in bodily harm or pain are required to establish the case. In order to qualify for a divorce in Illinois, the party must have been a resident of the state for a year, unless the offense or injury listed as grounds was committed in the state. A woman bought an air conditioner from a reputable national firm. How­ ever, two weeks after it was in­ stalled it broke down in the early summer. A repairman, who came on the woman 's request and was not af­ filiated with the manufacturer or the store, examined the unit and told her that the motor had burned out and that a replacement was necessary. On learning this, the woman told the store man­ ager that she wanted a new unit and refused to allow the company to repair the one she had. As a matter of fact, the store manager had sent a factory authorized re­ pairman to her house with a new motor, and she refused to let him enter and repair the unit.
