McHenry, The Law Serves You Tenants Rights Protected Under Strict Illinois Eviction Laws Many people believe that leases are for the landlord's protection and that tenants have little recourse when it comes to fighting for their rights However, under Illinois law, tenants are protected by a strict procedure for eviction which varies depending on whether or not there is a lease For example, can a vigilant landlord place a tenant's possessions on the front sidewalk, turn the key in the apartment and declare the tenant evicted9 Not without an order from the court, says the Illinois State Bar association, and to receive this directive he must first sue the tenant „ If the tenant is delinquent in rent payment, and if there is no written lease which provides otherwise, the landlord must serve the tenant a notice which simply states that the tenant must leave the premises within that time period The length of the time period depends upon whether the tenant rents weekly or mon thly, or for some other term When this period elapses, the landlord may sue if the tenant remains The landlord can also give a five <iay notice which permits the tenant to pay his rent within *LAFF OF THEJNEEK 'Now where were we? I remember a winter in northwest Kansas, when We re modeled the house. Just as we had so windows out the tempera ture dropped to 26 degrees be low! We did everything to keep warm. We used old lumber in the stove that smoked; we put on coats and mittens and still our teeth chattered. The only place scheduled to be read at 8 o'clock Tuesday evening. A funeral Mass will be offered at 10 o'clock Wednesday in St. Thomas the Apostle Catholic church, Rt. 176 and Oak street, Crystal Lake. Burial will be in Crystal Lake Memorial Park cemetery. wc kept tolerably warm was in bed, and then only tolerably. Na turally we put back those win dows, but it slowed down the re modeling. When it was almost Christmas, we had invited company before it got too cold. I made acres of cookies and mountains of green jello. We washed the clothes and hung them out on the line, and they froze stiff as it started to snow We pried them off the line and brought them into the house. The long johns stood like tall ghosts awhile and then sank like dampened spirits. It snowed and snowed, and blew the telephone lines down. The snow drifted across all the roads. For ^lajrs we sat around eating cookies and green jello, because nobody showed up. the five days and stay in the premises If the tenant pays the rent vuthin the five days, the proceedings are stopped If the tenant does not pay, then the landlord may sue The five-day notice is void if the tenant at tempts to pay the rent within the five days and the landlord refuses to accept the money. When a landlord wants a tenant to vacate for reasons other than non-payment of rent or other breach of agreement, different rules apply For individuals not on a written lease who pay their rent on a weekly basis, the landlord must provide a seven day notice Tenants without a lease who pay on a monthly basis have at least 30 days to vacate upon receiving the notice. In both cases, the notice should require vacating at the end of the term. Also in both cases, if the landlord decides to accept the rent money for the term after the date for vacating the premises, the notice is void. The landlord has the right not to faccept the money if it is offered to him, and if he does ^not, the notice is valid and binding If a tenant is under a written lease, this document usually provides for the time of the notice to be given After the specified period, the landlord may sue the tenant for the premises Announcing CLEARANCE SALE AT NOLAN FURNITURE 214 Main Street 18151 338-1124 Woodstock, Illinois We have drastically marked down our prices for this sale . . . included are floor samples, special purchases, one - of - a - kind pieces and discontinued items.
