JANUARY 31, 1973 am g KIWANIS NEWS WONDER LAKE CLUB Larry Isaacs, a graduate ex­ change student from the Union of South Africa at Mc Henry high school, told members at tfce Jan. 15 meeting why he is justly proud of his home country. A camera buff, Larry showed slides and presented in­ teresting and educational explanations of his country's people, its wild life and topography; also, the modern architectural beauty of the big city buildings which house financial institutions, hotels, office and municipal buildings. Larry related that his country is twice the area of Texas. It has a population of 20 million people, is the world's riggest producer of gold and iigh school students must go lirectly into a branch of the lefense services for at least a ;ix-month period. Larry said he vas a member of the Army on eave so he could take part in he student exchange program. The tall, dark-haired, bearded and distinguished young man said he was "ex­ tremely happy with so much here in McHenry county, especially with the friendliness of my fellow students". His highest praise, however, went to Mr. and Mrs. Charles K. Frantz and their three children of 7406 Mason Hill road, McHenry, with whom he is making his home. "They sure have made me a real member of their family, just like my own folks back home in Johannesburg," he added. During the regular business meeting, President Bob Stangl urged members to attend the Kiwanis Mid-Winter con­ ference which will be held Jan. 28 in the First United Methodist church, Crystal Lake. According to the Illinois State Bar association, the single most important consideration in every real estate transaction is the title. Is it a "clear" title unencumbered by the claims of others? That is the question every lawyer wants answered when he represents his client at a real estate closing. It is im­ portant to the seller who could be sued if the title he gives to property proves to be a faulty one. It is important to the buyer who certainly wants a title that is free of the claims or debts of previous owners. And it is why title insurance and an examination of the abstract of title are so important. The things that can go wrong are surprising in their variety. If a husband and wife were the sellers in some previous transaction, did both sign away their interest in the property? Has a mechanic's lien - a carpenter or other contractor's claim for some unpaid im­ provement - been filed on the property? Are there any claims for unpaid taxes? Ordinarily, any title defect will be uncovered in a title search, which is charac­ teristically painstaking and may go back into the record for 60 years or more. A lawyer also will inquire whether recent improvements have been made on the property to be sold. He will want to make sure that the contractors were paid and they in turn paid their suppliers and any subcontractors. The law allows a contractor to file a "claim for lien" which would be valid against the property for two years after completion of his work, regardless of any change in ownership. A sub­ contractor also may have a right to file a lien if he has given proper notice of non-payment to the property owner, even though the owner may haye paid the prime contractor in full. Title insurance is designed to insure the property owner against financial loss due to any question which may arise concerning his right to the property. By special provision, title insurance also may be adapted to provide protection against claims for property improvements which were not paid for by previous owners.
