i f The Law Serves You Complain To Seller But Make Payments The person who signs any installment sales contract should realize that the seller may assign the loan to a third party, known as the holder, who usually will have no respon­ sibility for the quality of the merchandise, according to the Illinois State Bar Association. Unless the seller is capable of financing the credit sale, the ISBA said the normal practice is to transfer the customer's loan to a bank, finance com­ pany or other lender who also assumes responsibility for collecting payments. However, responsibility for customer satisfaction with the quality of the goods purchased ordinarily remains with the seller. In most cases, the bar group said, either under terms of the retail installment contract or in a separate promissory note, the installment buyer must agree to make his payments to any person or company named in the note or any holder of the note. This usually includes an agreement not to assert against the holder any claim that the buyer may have against the seller. Under Illinois law, such agreements between the buyer and seller are enforceable. As a consequence, if goods are defective, the buyer must seek satisfaction from the seller while continuing his in­ stallment payments. However, the law does require that the buyer be notified at the time of purchase or whatever time his loan is to be transferred to a new lender. The buyer has five days after such notification during which he may assert a claim against the seller and «against the holder. This puts both the seller and holder on notice that the buyer may have a- legitimate legal defense in case of default on his payments. In any case, the buyer always has the right of recourse to the seller. In the case of an automobile buyer, the ISBA said the law guarantees his satisfaction to a cejtain extent.
