Direct Payment Of 71 Sales Tax Refund On Cars Illinois Attorney General William J. Scott has directed the state Department of Revenue to begin paying $3.7 million in sales tax refunds to approximately 330,000 persons who bought new cars and trucks in Illinois in 1971. Attorney General Scott said his legal battle to secure the tax refunds for Illinois citizens ended successfully this week when he was assured that his March 20 Illinois Supreme Court victory would not be challenged. On March 20, the state high court upheld Scott's contention that the Illinois General Assembly's 1972 appropriation of the $3.7 million for the tax refunds was constitutional. In February of 1973 the Cook County Circuit court had held the refund plan unconstitutional. The refunds stem from the Dec. 10, 1971, repeal of the federal excise tax on cars by Congress which made the repeal retroactive to Aug. 16, 1971. The Illinois Retailers' Occupation tax (sales tax) is calculated on the basis of the total sales price of the automobile which, in 1071, included the repealed Federal Excise tax, Scott explained. Persons seeking the sales tax refunds should apply immediately to the state Department of Revenue, Scott advised.
