Consumer Forurri by Illinois Attorney General William J.Scott Illinois is fortunate to have a number of beautiful waterways suitable for boating. But if you plan to purchase a boat, there are a number of state laws with which you should be familiar. Boating Laws--Registration 1. "Every motorboat, and sailboat over 12 feet in length, on waters within the jurisdiction of this state shall be numbered." To get a number for your boat, apply to the Illinois Department of Conservation. 2. After you receive your number from the department of Conservation, the law requires you to "paint on or attach to both sides of the bow (front) of a motorboat, or sailboat over 12 feet in length, the identification number, which shall be of block characters at least three inches in height. The figures shall read from left to right, be of contj>sttng'*>tolor to their bflCEgrounjL-and be maintained in a^eglble condition. No other number shall be displayed on the bow of the boat." 3. You must keep your "certificate of number" aboard the boat at all times of operation. A representative of the j Department of Conservation is entitled under law to board your boat at any time to inspect for compliance with all parts of this Act. 4. If you sell, transfer, abandon or destroy your numbered boat, you must notify the Department within 15 days. Motor Boat Equipment 1. Life Preservers According to the law, "it is unlawful to operate any watercraft unless there is one Coast Guard approved life preserver, ring buoy, buoyant vest or buoyant cushion in good and servicable condition and readily accessible for each person on board. Approved devices are identifiable bY the Laboratory-U.S.C.G. inspec­ tion label and numbers." 2. Lights - "It is unlawful to operate any vessel less than 26 feet in length unless the following lights are carried and displayed when underway from sunset to sunrise:" a. "A bright, white light aft to show all around the horizon, visible for a distance of 2 miles" (on a dark night with clear atmosphere). b. "A combination light in the forepart of the boat lower than the white light aft, showing green to starboard and red to port, so fixed as to throw a light from dead ahead to 2 points abaft (behind) the beam on their respective sides and visible for a distance of not less than 1 mile." (There are a number of other "light" laws for specific types of boats, including sail and muscular powered boats. Please check with the Department of Conservation for details.) 3. Other Devices - Motorboats also must be equipped with adequate muffler devices, whistles, carburetor arrestors and ventilators. 4. Fire Extinguisher - At least one U.S. Coast Guard approved fire extinguisher is required on all motorboats of 10 or more horsepower. 5. Sirens or Flashing Lights - Unless you operate an official patrol boat, it is unlawful to use a motorboat equipped with a siren or red or blue flashing lights. Operation of Motorboats Violation of any equipment or registration laws is a petty offense and carries a fine of not less than $10 nor more than $100. 1. "No person shall operate any motorboat in a careless or heedless manner so as to be grossly indifferent to the person or property of other persons, or at a rate of speed greater than will permit him in die exercise of reasonable care to bring the motorboat to a stop within the assured clear distance ahead." 2. "No person shall operate any motorboat, or manipulate any water skis, aquaplane, or similar device in such a manner as to endanger the life or limb, or damage the property of any person." Any person who violates any of the above provisions regarding operation of motorboats shall be guilty of a Class B misdemeaor. And, upon conviction, in addition to any other penalties authorized, he "may in the discretion of the court be refused the privilege of operating any watercraft on any of the waterways of this state for a period of not more than one vear." 3. "No person under 12 years of age may operate any vessel propelled by a motor of 10 horsepower or more unless the person is under the direct visual and audible supervision of a competent person 16 years of age or older who is qualified jnd capable of operating the vessel." 4. "No person shall operate any watercraft in a manner which unreasonably or unnecessarily interferes with other watercraft or with the free and proper navigation of the waterways of the state. Anchoring under bridges or in heavily traveled channels constitutes such interference if unreasonable under the prevailing circumstances." 5. "No motorboat may be loaded with passengers or cargo beyond its safe carrying capacity taking into consideration weather and other existing operating conditions." 6. "No motorboat shall be equipped with any motor or other propulsion machinery beyond its s&fe power capacity taking into consideration the type and construction of such motorboat and other existing operating conditions." 7. Note all restricted areas and not operate a boat therein except in cases of emergency. 8. Traffic Rules: (a) Passing. "When 2 boats are approaching each other head on or nearly so (so as to involve risk of collision), each boat must bear to the right and pass the other boat on its left side." (b) Crossing. "When boats approach each other obliquely or at right angles, the boat approaching on the right side has the right of way." (c) Overtaking. "One boat may overtake another on either side but must grant right of way to the overtaken boat." (d) Sailboats and Rowboats. "When a motorboat is approaching a boat propelled solely by sails or oars, the motorboat must yield the right of way to the sailboat or rowboat except, when a large craft is navigating in a confined channel, the large craft has the right of way over a boat propelled solely by oars or sails." 9. "It is unlawful...for any person who is an habitual user of narcotic drugs, or any person who is under the influence of intoxicating liquor or narcotic drugs to operate any watercraft on the waters of this State." Any person violating regulations 3-9 as listed here under "Operation of Motorboats" shall be guilty of a petty offense and fined not less than $25 nor more than $100. Boating in Illinois is regulated by the Department of Conservation. Though I have tried to list some of the major laws regarding boating in this State, I would suggest you contact the Department of Conservation if you have questions. There also are laws regarding water skiing, the business of boat rental service,. reporting accidents and transmitting information, regattas and races, capacity plates, and the sealing of marine heads. Boating is a sport which grows in popularity each year. Laws are written to help make it a safe sport. But the laws only work when they are obeyed by people! And one last word of caution: Please, please check the weather. If the forecast is bad, don't take the chance. Don't count on accidents always happening to "the other guy." After all, "the other guy" always is somebody who somebody loves... Q. - I received an honorable discharge from the Army two years ago, and plan to live abroad starting next year. A friend of mine told me I should check with the Veterans administration before departure. Why? - A . - To be apprised of how residence abroad effects your veterans' benefits. For one thing, you should get a statement of your service- connected disabilities (if you have any) from the VA office which maintains your medical records. The statement and an I application for medical benefits should be presented to the American Embassy or consular office in the country of travel or residence, should the need arise. a I A.
