Company is the sole owner of Lakeland Park Water Company, a public utility engaged in the business of drilling, pumping, treating and distributing public and food processing water to the residents of lakeland Park and Lakeland Shores subdivisions located in the City of McHenry, Illinois. B. The City desires to buy and the Company desires to sell to the City all of the assets of Lakeland Park Water Company, except its accounts receivable, on the terms and conditions hereinafter set forth. NOW, THEREFORE, It is mutually agreed as follows: 1. City agrees to purchase at a price of $67,500, pursuant to the terms and provisions of Illinois Revised Statutes, Chapter 24, Division 127, and on the terms set forth herein, the following described personal property and real estate: A. Personal Property: All the entire water works pumping treating, storage and distribution system of the aforesaid Lakeland Park Water Company, including, but not limited to all water mains, pipes, buffalo boxes, conduits gates, hydrants, shut offs and valves which have been erected over, under and upon any and all the streets, lanes, alleys, avenues, drives, roads and highways in said subdivisions in and outside of said subdivisions, together with the necessary easements and rights of ways in the operation of the aforesaid systems or any extension of same, the elevated storage tank and all machinery and equipment related thereto, all house services, meters, pumps, all water treatment and purification equipment and systems, all well pumping machinery and equipment, all water storage reservoirs, any and all existing plans and specifications of the water pumping storage and distribution system and its components, any and all existing maps relating to the said distribution system, the name and current address of all or its water customers, all water service contracts and all machinery equipment and parts relating to the production, storage and distribution systems of said Company not hereinbefore specified. B. Real Estate: All parcels of real estate owned by Lakeland Park Water Company consisting of the real estate on which wells No. 1 and No. 2 are located, the real estate on which the water storage tank is located and the real estate which is located at the end of Beach Dr., Lakeland Shores Unit No. 3. 2. The Company agrees to sell the aforesaid items of personal property and the aforesaid real estate at the price and terms set forth herein, and to convey or cause to be conveyed to the City a merchantable and unencumbered title to said personal property, by a proper Bill of Sale, and to the said real estate by a recordable Warranty Deed subject only to covenants, conditions and restrictions of record; private, public and utility easements of record; special taxes or assessments for improvements not yet completed; installments not due at the date hereof of any special tax or assessment for improvements heretofore completed; and general taxes for the year 1974 and subsequent years. 3. The City agrees to pay the aloresaid purchase price, plus or minus prorations as follows: A The payment of $7,500, plus or minus prorations at the closing of this transaction B The balance of the purchase price shall be paid to the Company after the closing of this transaction in five (5) annual installments of $12,000 each, with the first annual installment being due and payable to the Company on October 1, 1975, and with each subsequent annual installment payment being due on the 1st day of October in the subsequent years thereafter; said installments shall not bear any interest. 4 The time of the closing of this transaction shall be on October 1, 1974, unless subsequently mutually agreed otherwise, at the McHenry City Hall or at the law offices of Narusis & Narusis, provided that titles to the aforesaid personal property and to the aforesaid real estate are shown to be good or are accepted by the City; in the event tnat the City fails to close this transaction at the time specified herein, this contract snail, at the Company's option, become null and void. 5. The Company shall deliver possession of the aforesaid personal property and of the aforesaid real estate to the City at the closing of this transaction. 6. Company shall deliver or cause to be delivered to City or City's agent, not less than five (5) days prior to the time of closing, a title commitment for an owner's title insurance policy issued by the McHenry County Title Company in the amount of the purchase price, covering title to the real estate on or after the date hereof showing title in the intended grantor subject only to (a) the general exceptions contained in the policy, (b) the title exceptions set forth above, and (c) title exceptions which may WHY BURN UP GOOD MONEY TO KEEP A WORN-OUT HEATING PLANT ALIVE? If the title commitment discloses exceptions relating to title other than those referred to in the preceding paragraph, Company shall have thirty (30) days from the date of the delivery thereof to have these exceptions removed from the commitment. If Company fails to have these exceptions removed within this time, City may terminate this contract or may elect, upon notice to Company within ten (10) days after the expiration of the 30- day period, to take title as it then is with the right to deduct from the purchase price liens or encumbrances of a definite or ascertainable amount. If City does not so elect, this contract shall become null and void without further action of the parties. 8. General taxes, if any. and other similar items shall be adjusted ratably as of the time of closing. If the amount of the current general taxes is not then ascertainable, the adjustment thereof shall be on the basis of the amount of the most recent ascertainable taxes. Company shall pay the amount of any stamp tax imposed by law on the transfer of the title. 9. If, prior to closing, the improvements on said real estate shall be destroyed or materially damaged by fire or other casualty, this contract, at the option of the City, shall become null and void and the earnest money shall be returned to the City. 10. During the recent McHenry County Fair, the John Birch society booth conducted an opinion poll among interested visitors. Ninety-three questionnaires were returned. Members felt this was a good response. In answer to the question, "Do you think the power and size of the federal government should be: a) decreased; b) increased, or c) maintained at present levels," an overwhelming 56 thought it should be decreased. The local J.B.S. members found this significant, in the face of present, trends toward increased size and scope of government. Of eight questions on issues of vital current interest, the two questions which generated the largest number of identical replies were: "Do you believe the TV, radio and newspapers are giving you a) objective news; b) controlled news?" A whopping 67 out of the 93 replied that they were being given controlled news. The next highest response was to the question of shortages. Forty eight persons agreed that shortages are caused primarily, by government interference in the free- enterprise system. In answer to the vitally important question of what country is responsible for 80 percent of the heroin used by an ever-increasing number of our youth, only 38 people understood that it is Red China, not Turkey, which is the culprit here. Heroin, according to the society, is the major export crop of the Communist Chinese government, and vast areas of collectives are presently under cultivation. The local members of the John Birch society have undertaken to distribute information documenting this fact, some of it, they say, from goverrynent hearings which have never been made public. Ask Clergy To Cooperate In Safety Drive Secretary of State Michael J. Howlett has issued a plea to all Illinois clergymen to join in a campaign he hopes will reduce traffic fatalities over the Labor Day weekend In a letter mailed Aug. 19, Howlett asked ministers, priests and rabbis to use whatever means available to emphasize to their congregations that safe driving is a moral responsibility. He asked that they concentrate their efforts on the weekend of Aug. 25. "Respect for human life is basic to all religions," said Howlett. "There is no better way to show that respect than through safe driving." Last year, there were fifty fatalities over the Labor Day weekend in Illinois. Howlett said the National Safety council projects that 450 to 550 motorists will lose their lives on our nation's highways over the Labor day weekend this year, from 6 p.m. Friday to midnight Monday. "This is the lowest national projection since 1963," Howlett said, "but by stressing moral responsibility we hope to lower the toll even more in Illinois." A total of 559 motorists were killed over the Labor day weekend last year. During past generations, the salt shaker was very often the most valuable and ornate thing on the family table. Salt was scarce and valuable. Karen Kottke 385-6675 Pet Population Provides Problems For Residents It seems as if the pet population has increased considerably in this area since we've become more populated. We are beginning to have a problem with the number of animals running at large. Many of our new residents may not be aware of the leash laws in McHenry county. These laws apply to all domestic pets, not just dogs. All pets are to be confined to a pen or yard, if you do not have a fenced yard, then the pet is to be on a leash! Anyone may call the County Rabies Control if an animal is at large. If for no other reason than your pet's safety, please see that your animal is on a leash or penned. No one has to put up with an unwanted animal. Have enough respect for your neighbor to contain your pet within your property boundaries. We may live in an unincorporated area, but the laws are applicable here as well as in incorporated areas. Don't be angry with your neighbor for calling the Rabies Control about your pet if you haven't enough love for the animal to keep it out of trouble. If everyone was considerate enough and cared enough to see that their pets were properly restrained, the Rabies Control Department would be out of business. As I've warned before -- the county uses a tranquilizer gun on animals at large; the tranquilizer is powerful enough to fell a large animal, that means that when used on a small animal it will be fatal. The choice of responsibility is up to the pet owner. SOFTBALL LEAGUE The McHenry Women's Softball League was awarded two trophies over the Aug. 17-18 weekend. In the Saturday game, Debbie Mahon hit a grand slam homer which helped the team to win the first place trophy in the McHenry County Girls Softball League tournament. In Sunday's game against Hebron, Eileen Connell pitched five of the six innings played in the game. Eileen left the game with a 13-0 shutout in the progress. The game was called at the end of the sixth inning with McHenry winning 17-2. This win enabled the McHenry team to capture first place in the Women's Softball tournament. LEADERSHIP NEEDED The Holiday Hills Girl Scout troop 478 is in desperate need of leadership. The past year's troop leaders are both deeply involved in other activities and are unable to provide the necessary leadership for the troop in the coming year Anyone interested may contact Marge Connell at 385-3756, Tillie Williams at 385-8654, or Linda Thietje at 385-6483 for details. The troop begins its year in September and a registration drive should be the first week of September, so time is of the essence. If new leadership for this troop is not found the troop will lose its charter, so it's hopeful that the mothers of girls to be enrolled as Girl Scouts this year will give this problem serious consideration. BOWLING FINALS The Ladies Thursday Nite Handicap League held an awards banquet at a local McHenry restaurant on Thursday, Aug. 22. Prizes were awarded in the following categories - First place trophies to team 6; Maddy Radunz, Anna Harris, Velma Garrelts and Dee Moerdick; Individual high series scratch award to Martha Williams with a 503; Individual high game scratch to Velma Garrelts with a 205 game; Individual high series with handicap to Maddy Radunz - 638; Individual high game with handicap to Sharon Mazza with a 252; and Most Improved Average to Anna Harris with a 21 point increase from an 80 to a 101 over the season. All the gals enjoyed bowling in the summer league and we're looking forward to next year's league.
