Migratoiy Game Bird Hunting Ban Settled A lawsuit to halt migratory game bird hunting nationwide has been settled out of court by the U.S. Fish and Wildlife Service and four private organizations. As a result, waterfowl hunting will not be interrupted this year, and the Interior Department has agreed to prepare an environmental impact statement (EIS) before next year's migratory bird hunting regulations are issued. The suit was filed because an environmental impact statement was not prepared for the 1974-75 migratory bird hunting season. The National Environmental Policy Act requires that major Federal actions significantly affecting the quality of the human en vironment must be preceded by publication of a detailed statement by the responsible official on the environmental impact of the proposed action. The EIS will describe and evaluate the long established procedure for setting migratory bird hunting regulations in the United States and the extensive data gathering programs on which annual decisions about regulations are based. Moreover, as part of the agreement the EIS will discuss and evaluate the points of rnnrprn expressed by the plaintiffs in the case, who are the Fund for Animals, Inc. ; the Humane Society of the United States, New Jersey Branch; Wildlife Preserves, Tflfr; and Deer Ecology Environment and Resources, Inc. The points to be considered in connection with the preparation of the EIS include shooting hours, bonus bags, bonus and special seasons, hunting of restricted species, the point system, and hunting of cranes, swans, and mergansers. Other points of concern to the plaintiffs were simplification of waterfowl hunting regulations to the extent possible; requiring a duck stamp for all waterfowl hunters regardless of age; encouraging more effective enforcement of migratory bird hunting regulations; and more direct participation by the plaintiffs in development of annual migratory bird hunting regulations. In the agreement the plaintiffs reserve all r ights to challenge the EIS with the exception that once the EIS is completed the plaintiffs will be barred from legal action challenging it on the scope of the subject assessed. They retain the right to challenge the quality with which the subject is treated, however. Deaths EMMAM. MAY Mrs. Emma M. May, 83, of 1907 North street, Spring Grove, was pronounced dead on arrival at McHenry hospital Sunday, Dec. 1. Mrs. May was born in Johnsburg Nov. 20, 1891, daughter of Jacob and Elizabeth Freund. She lived all her life in the Spring Grove- Johnsburg community. The deceased was a life and honorary member of the Christian Mothers sodality of St. Peter's church, Spring Grove. Her husband, Ben J. May, died April 24, 1971. She is survived by four daughters, Arlene at home, Mrs. Steve (Estelle) Schmitt of Elkhorn, Wis., Mrs. John (Shirley) Sanders of Richmond and Mrs. John (Joan) Popelka of Spring Grove; two sons, Bernard of Spring Grove and Allan of Mundelein. Other survivors are nineteen grandchildren; eight great grandchildren; two brothers, John B. Freund of Solon Mills and Ernest Freund of McHenry; three sisters, Miss Helene Freund, Mrs. Margaret Masquelet and Mrs. Verna Burton of McHenry. Two sisters and five brothers preceded her in death, Mrs. Susan Steinsdoerfer, Mrs. Mayme Huff, William, Peter, Nicholas," Hubert and Joseph Freund. The body rests at the Peter M. Justen & Son chapel until Wednesday morning, when a funeral Mass will be offered at 10 o'clock at St. Peter's church, Spring Grove. Burial will be in the church cemetery. VIRGINIA ANN TOBIN Virginia Ann Tobin, 80, of 2510 S. Birchwood avenue, Villa Vaupell, McHenry, died Nov. 30 in her home. She was born Feb. 10, 1894, in Colfax, Wash. The deceased was a retired sales clerk for Mar shall Field & Co., where she was employed forty-two years. Private services were held Monday, with arrangements made by the Peter M. He was a member of the Church of the Holy Family, Rt 59, Lake Villa, a veteran of World War II, 203rd. General hospital Corps., U.S. Army in Europe; belonged to the Park Ridge V F.W. Franklin, 78, of 217 James road, Spring Grove, died Nov. 30 at St. Therese hospital, Waukegan. He was born Dec. 28, 1895, in Staten Island, N.Y., the son of Anton and Sophie Franklin. Mr. Franklin served in the Canadian Army Artillery in World War I. He was employed as a machinist and retired 13 years ago. On July 24, 1925, he married Margaret Madden in Chicago. She survives. Other survivors are a daughter, Mrs. Edith Mantel, Spring Grove, a son, Robert of Milwaukee, six grandchildren and three great grandchildren.
