Thomas Hanahan and others by a Federal grand jury on charges of extortion and mail fraud, many people have assumed that I would be appointed if Mr. Hanahan is convicted or steps aside until he is cleared. Since we were both nominated by the Democratic party of the 33rd district and ran on the same ticket for the office, one can understand the assumption. But it's wrong. Your readers may be interested in the actual procedure. "Under state law, an elective office is declared vacant if the incumbent is convicted of an "infamous crime." Thus, if convicted, Mr. Hanahan would lose his office of state representative. "By law, his successor would be appointed, within 30 days, by the Legislative committee of the Democratic party in the 33rd district. This committee is cotnposed of the Democratic party county chairmen of the five counties lying within the 33rd district. Their appointee would serve uhtil January, 1977. In choosing the successor, each of the five county chair­ men would have a vote equal to the number of votes cast in his county for Mr. Hanahan last month. "This much is clear. What follows is less clear, and very much in need of attention. "Mr. Hanahan is a precinct c o m m i t t e e m a n a n d Democratic party chairman of McHenry county. In the Nov. 5 election, he received 22,000 votes from McHenry county out of his total of 33,000 in the district. Thus, Mr. Hanahan would control two-thirds of the vote of the Legislative com­ mittee.
