NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of McHenry Shores, Illinois, as follows: Section 1. OBSTRUCTIONS AT OR NEAR IN­ TERSECTIONS ON PRIVATE PROPERTY: It shall be unlawful to construct or maintain, or permit to remain, any fence or other structure or any bushes or other plants, including trees, on a corner lot at or near an intersection which obstruct the view for vehicle or pedestrian traffic. Any person, firm, or cor­ poration violating any provision of this section shall be fined not less than ten dollars nor more than five hundred dollars for each offense; and a separate offense shall be deemed committed on each day during or on which such ob­ struction to view is permitted to remain after written notice from the police department or any official of the Village to remove or trim the same. Section 2 PLANTING IN RIGHT OF WAY: It shall be unlawful to plant any tree or shrub in any public street or parkway or otner public place without having first secured a permit therefor. Applications for such permits shall be made to the Village Clerk, and shall be referred by her to the President and Board of Trustees. Section 3. REMOVALS: It shall be unlawful to remove or cut down any tree or shrub in any street, parkway or other Eiblic place without having rst secured a permit therefor. Applications for such permits shall be made to the Village Clerk, and shall be referred by her to the President and Board of Trustees for approval before permission shall be granted. Section 4. INJURY: It shall be unlawful to injiire any tree or shrub planted in any such public place. Section 5. AD­ V E R T I S E M E N T S O R NOTICES: It shall be unlawful to attach any sign, ad­ vertisement or notice to any tree or shrub in any street. parkway or other public place. Section 6. DANGEROUS TREES OR SHRUBS: Any tree or shrub-which overhangs any sidewalk, street or other public place in the Village in such a way as to impede or interfere with traffic or travel on such public place or which obstructs the view for vehicle or pedestrian traffic shall be trimmed by the owner of the abutting premises on which such trees or shrubs grow so that the obstruction shall cease. Any limb of a tree which has become likely to fall on or across any public way or place shall be removed by the owner of the premises on which such tree or shrub grows or stands. In addition to any other remedy the Village may have hereunder, the Village shall have the right to trim or remove any tree on the public right of way or parkway; if the owner of the abutting premises fails to remove or trim any tree or shrub in violation of this Section after five (5) days written notice from the President or Village Gerk after such notice is authorized by the Village Board, then such abutting owner shall be liable for all costs incurred by the Village in removing or trim­ ming such tree or shrub; such costs shall be paid by the abutting owner within 30 days after being billed for same by the Village. Section 7. WIRES: It shall be unlawful to attach any wire or other rope to any tree without ~ jrmission of the President and ird of Trustees. Section 8. PIPES: Any person, firm, or corporation maintaining any gas pipe in the Village shall, in the absence of provision in the franchise concerning the subject, keep such pipes free from leaks. Section 9. EXCAVATIONS: In making excavations in streets or other public places, proper -care shall be taken to avoid injury to the roots of any tree or shrub wherever possible. Section 10. PENALTY: Any person, firm, or corporation violating any provision of this ordinance shall be fined not less than ten dollars nor more than five hundred dollars for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. Section 11. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 12. Pursuant to Ch. 24,1-2-*, 111. Rev. Stats., (1973) it is hereby declared that it is urgent that this Ordinance shall take effect immediately upon its passage as provided by law. Lindberg has released statistics of payroll checks issued to state employees for work performed in November, 1975. There were 117,382 em­ ployees of all state agencies in November, 1975, an increase of 230, or .2 percent over October, 1975. Exclusive of educational institutions, the November, 1975, total was 77,045, an in­ crease of 447, or .6 percent from the October, 1975, figure. Changes by major groups were: Constitutional officers and courts up 14, or .2 percent; Code departments up 387, or .6 percent; Major commissions up 74, or 2.1 percent; Miscellaneous agencies down 28, or 1.6 percent. Payrolls for all agencies totaled $112,457,981, an increase of $3,102,346, or 2.8 percent, from October, 1975.
