Following are some of these questions with what is hoped are clear, un­ derstandable answers. The information was supplied by the McHenry County Defen­ ders. Why do we need a new zoning ordinance? The one under which we are presently functioning was written in 1946 and is badly out of date. Farm land is leaving production at the alarming rate of 6,000 acres a year in McHenry county alone. The new zoning ordinance is an effort to slow the speed with which farm land is being taken out of productivity and being covered with subdivisions, shopping centers and roads. What does the ".'15 acre minimum" mean? The "35 acre minimum" refers to the smaller size that agriculturally zoned land can be divided into with going through rezoning A land owner can divide land into smaller 1, 2,3,5, 10 etc. - acre parcels, but in order to do so he must apply to have the land rezoned, just as he must do now for 1, 2, 3, or 4-acre lots. A land owner would have to rezone in order to subdivide (a logical procedure, since change in land-use should be reflected in a change in zoning). In so doing he would likely petition for 1, 2, or 3-acre lot sizes rather than dividing into what is now easier, 5-acre parcels. By applying for rezoning, the Zoning commission and af­ fected neighbors will have a chance to review and object to or approve of the change if they would like to do so, which is not the case now with 5+ larger acre lots. The Zoning com­ mission could help guide the growth of the county so that population concentrations will be at the outskirts of our cities rather than scattered across the countryside. Support for the 35 acre minimum has come from the McHenry County Conservation district, the Farm Bureau, League of Women Voters of Crystal Lake-Cary, McHenry County Defenders, McHenry County Audubon society, the Bull Valley association, plus many individuals, including farmers and other landowners. Opposition has come from the Board of Realtors, many developers and some in­ dividuals. What does the'intensive agriculture conditional use" mean? The proposed zoning or­ dinance Avould allow, but not make it mandatory, for a farmer who operates an in­ tensive farming operation, such as feed lot or grain dryer, to petition for an Agricultural intensive use permit The petition would come before the Zoning commission . and surrounding land owners. If granted, the conditional use would restrict development within a 's-mile radius of the site of intensive use (the dryer or the feed lot. not the boun­ daries of the farm). A farmer feeling no need for this kind of protection need not apply Both the farmer who has invested a great deal of money in his operation and potential home purchasers in the area could be protected by something of this sort. Some groups have challenged the constitutionality of this proposed Ag intensive zone. In fact, many groups and in­ dividuals that have supported the 35-acre minimum feel that the problem of intensive agriculture exists, but that perhaps there is another more acceptable solution. • The special zoning committee will be working on alternatives. What is the section dealing with "prime soils" about? Soil quality information as supplied by the U.S. Soil Conservation service will be used when zoning is applied for, along with many other criteria. Soil quality is often now con­ sidered, but nothing in our present ordinance says it should be done. It is proposed that it be included in the new ordinance Can we still have a say in the new Zoning Ordinance? The proposed ordinance was been worked on for 10 years, with input along the way from affected groups. Townships hearings have been held in the past 2 months in all 17 McHenry townships. These township hearings have been set up to receive input from the citizens at large and have been well publicized and well attended. Although the township meetings are over, people can still express their support or criticism, in whole or in part, to the Zoning Ordinance by writing quickly.
