Title IX of the Environmental Protection Act provides for individual variances upon proof by the Petitioner that com­ pliance with specific provisions of the Act, related regulations or Board Opinions would im­ pose upon the Petitioner an arbitrary and unreasonable hardship". The Petitioner alleges such a hardship, and requests permission to be exempt from Rules 402 and 404 (f) of Chapter 3: Water Pollution of the Illinois Pollution Control Board's Rules and Regulations, as these rules apply to the discharge of BOD from the Ringwood jplant into an unnamed dutch which flows into Dutch Creek. Proposed interim limitations are 25 mg-1 BOD with no single daily composite sample exceeding 50 mg-1. Petitipner requests the variance until May 31, 1984, or until the Board accepts Petitioner's proposal, R79-8, in which similar relief has been sought through a regulatory change, whicnever is earlier.
