MARCH 21.1980 ISBA Starts Prepaid Legal Services A program that will enable corporations, unions and- other groups to offer their employees and members prepaid legal services to help with estate planning, real estate transactions, warranty enforcement and many other commonly needed services, has been inaugurated by thfc Illinois State Bar association (ISBA). Under the ISBA program, organized groups of 500 or more members will be of­ fered free assistance in adopting a model plan developed by the ISBA and adapting it to reflect the individual needs of their members.* Organizers gf groups forming under ISBA auspices will be offered the following. Access to the services of an organization of professional administrators. Groups choosing to employ this centralized service will save the cost of establishing administrative offices of their own. ISBA attorney-volunteers to serve on the governing boards of each group plan. Selection by group members of any attorney of their choice, or use of the statewide network of lawyer referral services. Although inquiries are invited from any group, the ISBA's program will first be targeted towards Illinois- based corporations with 500 to 1,000 employees. Per­ sonnel managers of 75 such firms will receive brochures this week outlining the program. The model plan conceived by the ISBA includes such common services as wills and estate planning, real estate transactions, con­ sumer transactions, lan­ dlord-tenant disputes, d o m e s t i c r e l a t i o n s problems, adoption, change of name, traffic offenses, administrative proceedings, conservator or guardian estates, warranty en­ forcement, bankruptcy and probate. Each groups' plan will be negotiated with ISBA representatives to deter­ mine the monthly cost, range of services and legal fees. Joliet lawyer Bruce D. Falk, chairman of the ISBA's Delivery of Legal Services committee, said any group can adopt the ISBA-sponsored plan, but it is especially designed to be used by employers or unions as a new generation job benefit. Falk said the Bar association's decision to promote the prepaid legal service concept is an outgrowth of studies showing , that up to two-thirds of all Americans are failing to get the legal services they require. "It is workjng people who need prepaid legal ser­ vices," Falk explained. "These are the people who earn too much to qualify for legal aid, yet fear they cannot afford to pay for the kind of assistance they need." Falk emphasized that the ISBA will not profit finan­ cially from the plan. "There are no pooled funds under our plan," he said. "Each group that comes to us will have its own policy board, its own separate administration, and have its funds segregated and used only for services to its own mem­ bers." The prepaid plan would not cover legal services for commercial activities, cases in which the attorney would receive a fee contingent on success, or legal services for which a person is insured (auto insurance), A typical plan developed under the ISBA program leaves the choice of lawyer entirely up to the individual plan members, and specifies the hourly fee and the I amount of time that will be reimbursed for each service available. " For example, a typical plan might permit every member and his or her immediate family to seek legal assistance in preparing a will and planning an estate. In any given year, the typical plan might provide payments for up to four hours of service at $40 per hour for this particiular benefit. "A member is free to pay a higher hourly rate and to spend more time ac­ complishing his tasks, but the extra time and charges will be at his or her own expense," Falk said. According to the ISBA chairman, "Any plan negotiated with the ISBA will include an established grievance procedure and a policy on accrued benefits. We believe it is the best plan yet conceived and we are eager to work with em­ ployers, unions and other groups in getting it established and under way." Falk said the ISBA at present is willing to help any grotip of 500 or more members to implement a plan. It is possible that smaller groups, combined with others of like interest to form one group, could receive Isba assistance in developing a prepaid legal service plan.
