Sept. 2,9 & 16,1981) No. 810428 Past 65 by Carl Riblet Jr. Q. "Can a man married to the same woman for 56 years hope to get a divorce if he can't stand living with his wife anymore? I am 77. We live in a state that has no- fault divorce, meaning that neither takes the blame. She's willing to let me divorce her but she wants most of the money and we have quite a bit" - Bedford H. A. Yes, Bedford can get a divorce in his state once the matter of property division and alimony is settled. The case will go to court if they cannot agree out of court on a division of money. The length of time they have been married is not a factor. Division of property is the factor. , Q. "I am interested in learning about trusts that may be especially suitable for a two-year-old grand child. Could you advise me? I am not yet ready to establish a trust for my grandchild, but I want to study about trusts with an eye on the future." - Violet W. A. I am not at all wise about trusts and, in fact, am sort of sour on them. My brothers and I lost out en tirely on a relatively large trust left to us by our parents because of mismanagement by the large bank that ad ministered it. Violet can go to her bank with the above caution in mind, she can go to an in vestment counselor and she can ask an experienced, reputable (and expensive) tax practitioner - a certified public accountant. Q. "My aunt who is living with me gave her age as three years younger than she is when she went on her company's hospital plan. Her Social Security files will show her correct age. There was no harm done to anyone.. When she reaches 65, her hospital plan will still show three years to go before catching up with SS and Medicare. Is it possible for her to continue her pre-65 hospital plan and not apply for Medicare until she reaches the age given to her hospital plan?" - A.E. A. I would think so. She can apply for Medicare anytime after 65. It was a white lie. "You wrote that Floyd D., who is tied to a wheelchair, needs in formation on where to get reading matter. You could tell him that the Free Library of Philadelphia, Pa., 919 Walnut street, phone l- 800-222-1754, supplies reading material and cassettes and machines to play the cassettes for those who are blind and physically handicapped. The service is provided through one of the best acts of Congress." - John B. A. Thank you, John. I hope Floyd reads John's letter Q. "You wrote that somebody past 75 who is not eligible for Social Security can still get Medicare coverage. The SS office here says that statement is in error because they don't know of any such policy. Are they wrong?" " Ruth C.W. A. Social Security in formed me this very day that anyone over 75 who is not on SS can indeed get Medicare. Ruth can make certain simply by applying for Medicare. Q. "I now receive $525 a month from Social Security and my wife gets $281 a month. At my death would my wife receive any larger benefit by combining mine and hers or would she receive the smaller benefit?" - E.A.S. A. When and if she is past 65 and living when and if E.A.S. dies, she, as his wife, will be entitled to the full amount* of his benefit. She will not continue to receive her benefit. In cases of death, the payments are adjusted by SS so that the larger amount that one of the two receives is what is paid after death. Q. "I will retire at 62. I worked for the railroad 10 years and have been paying into Social Security for 13 years. I have been told by some who know that I can't get benefits from both SS and the Railroad Retirement board. If that is .true, J ,rqnnnt understand why." - C.S. „ A. H is rioftrue. C.S. will receive monthly benefit checks from both the Railroad Retirement board (if he worked for the railroad at least 10 years) and SS. Write to Carl Riblet Jr. at Box 40757, Tucson, Ariz., 85717 with self-addressed, stamped envelope for an swers to any specific problem on aging. All letters are answered, if possible. No identities are revealed.
