New Driver Responsibility In 1982 The present "DWI" (driving while intoxicated) law will be changed as of the first of the year to the "DUI" (driving under the in fluence) law. The new law will cover driving or in physical control of any vehicle within the State of Illinois, while under the influence of alcohol or any other drug or combination. Once arrested for "DUI", the violator will be requested to take a breath test to determine the amount of alcohol in his blood, after being warned that refusal to take the test will result in suspension of his or her driver's license for six months on the first offense,- and 12 months for the second and each subsequent such arrest and refusal within five years. The 90-minute waiting period for the violator to decide whether or not they would take the test has been dropped and only one breath test will be given instead of the two presently employed. A blood or urine test may also be requested if the breath test leads to the presumption that the violator is under the in fluence of drugs or a com bination of drugs and alcohol. In other motor vehicle related laws passed by the Illinois Legislative session this year, free passenger car license plates will be provided for former prisoners of war residing in the State of Illinois. The Secretary of State may suspend, for 30 days, the driver's license of anyone arrested for the approaching, overtaking and passing of a stopped school bus while the signals are flashing. House Bill 1117 prohibits any person from driving a motor vehicle for the pur pose of providing tran sportation for the elderly in connection with the ac tivities of any organization unless such person meets certain requirements per taining to driving ability and past driving record. Fees for original driver's license will be raised from $10 to $20 with $16 of the $20 fee being placed in the State Driver's Education fund. effective Jan. 1, 1982. The Illinois State police will now have the power to "Red Line" or put out of service any carrier, driver, or vehicle in violation of the "Federal Motor Carrier Safety act". This will be applicable to vehicles registered for a gross weight of 12,001 pounds or more. Captain vHugh S.
