Attorney General Ty Fahner on Monday when he emphasised the enforcement of the harsher of two drunk driving laws until the courts decide which law is valid. He said the Legislature psssed two laws laat year aimed at raviaing drunken driving statutes, but a class- action suit challenging the harsher law is before tbe Cook County Circuit court. Fahner, during a conference McHenry county courthouae, plained that in reviewing the legislative debate and proceedings, it is dear that lawmakers intended the stricteet law to reflect state policy on dealing with drunk drivers. "The stricter version of the law is controlling, becauee it was passed by the General Aaeembly after the conflicting version," said the attorney general. He noted that the rule of law applies even though both bills were passed on the same day, seperated by only a few Hot its He said prosecutors and courts have taken differing views of what provisions of law are in force regarding drunk driving. The con flicting versions of the law relate to the effects of blood tests on trials for driving under the influence and warning required before a peroon refuses to talks a blood teat. The stricter version of the drunk driving law which Fahner supports requires a suspected drunk driver to submit to a blood teet. If the suspect refuses the teet, under the stronger law, the refusal can be used aa evidence in a court trial. A refusal of the teet can reeult in loes of driving priveleges, an automatic driving suspension for six months. In regard to another question relating to drunk driving, Fahner aaid he is working to plug the gap in the Illinois Vehicle code which permits large numbers of drunk driving caaea to go unreported to the Secretary of State's office. The attorney general explained that the language of the vehicle code does not now require the reporting of drunk drivers when such persons are placed on court supervision Without referral to a driver remedial or rehabilitative program. Fahner praised Flora far his strong, stand on the drunk driving laws and noted in McHenry county it la not the practice of the state's attorney's of fice to place drunk drivers on supervision without a stipulated remedial or rehabilitative program. Fahner said circuit court clerks are not required to forward records of people placed under court supervision for drunken driving. Supervision orders do not constitute "convictions" under the low, according to Fahner, and only convictions must be reported to the secratarv of atate. "In my opinion, there ie nothing in the law to prevent circuit court clerka from voluntarily reporting court supervision casee aa Secretary of State Jim Edgar haa requeeted," Fahner said. Edgar has criticised the drunk driving laws of the state becauee they do not require such notification, said the attorney general. Fahner said the stranger law on drunk (hiving, including the reporting of supervision to the secretary of state, would be propooed to the Legislature later this yeer.
