Gruner was charged following a collision betweennis car and a vehicle driven by Geren on U.S. 14 in Cary. Testimony in the trial in­ dicated that Gruner was driving under the influence of liquor at the time of the 2 a.m. accident, when his car allegedly crossed the center line of the highway and collided with Geren's vehicle. At Wednesday's sentencing hearing, the defense counsel tola the court that Gruner was convicted on "an unintentional crime," and that an appropriate sentence would be probation. Judge Brody emphasized the dangers of driving under the influence of liquor, which he said impairs the driver. "It is obvious to the court that whatever I do today cannot restore a life," the judge said when citing the gravity of the case. Brody said he was "distur­ bed" that Gruner had not learned his lesson. The defen­ dant had a previous driving while intoxicated conviction. The judge said he believed incarceration was inap­ propriate. However, Broay added that Gruner and the public should be shown that driving under the influence will not be tolerated by the court. The defense asked for a hearing on a new trial for Gruner, but as the motion had not been filed within 30 days of the conviction, the court said there was "nothing to be heard."
