Building permits should be obtained by the contractor, and the contracting firm should provide liability insurance to protect the homeowner in case of an accident at the Job site. The contract should comply with state truth-in-lending laws, and guarantees should be clearly stated. "Most contractors will guarantee general work for one year. Roofs may be guaranteed for five years, and siding guarantees will differ depending on what type it is," Lundeberg said. One of the more important aspects of a contract is that the homeowner be given the right to cancel the contract for three days after it is signed. "This is very important because some disreputable builders can pressure peo­ ple, especially the elderly, into signing a contract right on the spot," Lundeberg said. If asked to make a deposit by check or money order, it should be made out to the contracting firm and not an in­ dividual, he said. Also, homeowners should be certain that any spoken pro­ mises by salesmen or contractors be written in the contract. Lundeberg said the contract should spell out what the entire job will cost, in­ cluding extras. Homeowners should read the contract and be sure they understand it, and should be assured of getting a complete, readable version that has been signed by an officer of the contracting firm. Perhaps most importantly, he said that remodelers should receive the con­ tractor's affidavit accompanied by a waiver of mechanics liens when paying the contractor. Such a lien is filed against work done by a subcontractor if he is not paid by the contractor. If this happens, a homeowner will not be able to clear the title to his house when selling it unless he pays the subcontractor, Lundeberg said.
