Court is taken to task in bankruptcy proceeding By TIMOTHY BANNON United Press International EVANSVILLE, Ind. - The FBI is investigating allegations that owners and employees o! a family firm stripped nearly $L2 million of its assets while the company was under bankruptcy protection and federal court supervision, bureau sources say. Although the federal probe is not directed at U.S. District Court Judge Gene Brooks, some parties in the case have questioned his conduct and the 7th U.S. Circuit Court of Appeals in Chicago has made inquiries, Brooks' critics, including two men accused of skimming money from Property Developers Inc., assail his general handling of bankruptcy matters, including some appointments of his lawyer friends to handle casework. The critics also charge -- and they are confirmed in 19 volumes of court files in Evansville -- that the judge has had off-the-record contacts without both sides pre­ sent, a practice discouraged in the Judicial Code of Conduct. In interviews with United Press International, Brooks denied any impropriety. The imbroglio, which a court- appointed receiver says involves improper use of $1.19 million in PDI assets, pits the judge against a powerful southern fjpdiana fami­ ly headed by Ferris 12; Traylor. ByRobGloster United Press International NEW ORLEANS -- One major mistake World's Fair officials made was inviting hundreds of reporters and photographers to tour the exposition the day before it opened -- while it still looked like a construction site. One day before the May 12 open­ ing, the nation got its first glimpse of the $350 million fair -- in­ complete pavilions, reporters in hardhats and piles of garbage. By presenting an unfinished product, fair officials tarnished •• i irv I., • -- the image of their extravaganza, which attracted small crowds, lost- $140 million and filed for bankruptcy days before its Sun­ day closing. But probably the worst mistake fair officials made was assuming they could save advertising dollars by encouraging the media to promote a positive image for the expo, which originally budgeted only $5 million for advertising. Even though stories leading up to the, fair were predominantly positive, reporters focused on financial problems once the show began. Numerous feature reports throughout the expo were over­ shadowed by stories about the fair's financial woes. "We were reporting facts that nobody wanted to hear. They were the truth," said Bridget O'Brian, who covered the fair for The Times-Picayune.The States-Item in New Orleans. "We didn't create the money troubles. We just reported them." With an absence of positive advertising, the fair's publicity was dominated by images of employee layoffs, grand jury in- flop vestigatkms and disappointing at­ tendance. Fair President Nil1; Spurney said that led to a "Caleb- 22." * "As you get negative publicity because you can't pay your bills, • you get less attendance," be said. "And it compounds your inability to pay your bills." Daily doses of bad news led fair musician Jim Turner to accuse journalists of being too cynical to understand the "fantasy" of the expo.
