PCB officials are now in the of scheduling a meeting tween representatives of McHenry County Sanitary and Recycling Center Inc. and leaders of the Landfill Emergency Action Committee (LEAC). The meeting will lead to a formal hearing within 90 days, according to a PCB spokesperson. The LEAC, a group of Huntley area residents opposed to a plan for a landfill on Route 47, has asked the PCB to assess $18,900 in fines against the landfill on Sand Road between Cary and Crystal Lake. According to records in Springfield, the landfill was cited for 189. separate violations by the Illinois Environmental Protection Agency (IEPA) between 1974 and Nov. 2, 1963. After first investigating the LEAC charges to see if they were redundant or frivolous, PCB officials authorized a hearing on the matter, said Lee Cunningham, assistant to the board chairman. The representative for James Veugeler, of the firm operating the Sands Road landfill, asked for dismissal of the case Feb. 4, PCB Clerjt Dorothy Gunn said. Veugeler is also president of McHenry County Landfill Inc., which is proposing the con troversial landfill near Huntley. Dale Berry, a Marengo at- nounce< torney representing LEAC, said f811-, 22 Veugeler's representative argued many of the 189 com plaints were past the statute of limitations. Berry said he ex pects the motion to dismiss to be denied because the statute of limitations "does not apply to Pollution Control Board en forcement proceedings." John Cloney, the' hearing4 officer assigned to the matter, wiH decide on the motion for dismissal al a hearing yet to be held, Bejrry said. Cloney said he only recently was given details about the case and has yet to set up a meeting between the two The PCB has 90 days to hold the hearing. Cloney said he has to give the board three weeks notice on the hearing date. That would push a hearing off at least until early March. "The hearing should be held in the coun ty...probably in Woodstock," Cloney said. LEAC's complaint was an nounced at a press conference Jan. 22. Nancy Grau, speaking for LEAC, publicly called for Illinois Attorney General Neil Hartigan to join the - in vestigation. Assistant Attorney General Bill Barzano refused to confirm or deny whether his office is investigating the landfill. "They (L&AC members) contacted us prior to filing their suit. Hiey brought evidence to us," he explained. "We're taking a look at the evidence they brought to us. That's about where it stands." According to Grau, the violations include: -Failing to properly cover trash at the Sands Road fill with cover, immediate and final soil layers. -Failing to "collect litter from a previous working day." >lluted liquid -Allowing a po byproduct of buried called leachate, to landfill. trash, escape the Stuart Brent, bookseller and man of letters, will address the Creative Living Series of the Woodstock Fine Arts Association, Thursday, Feb. 21. The program is scheduled for 10 a.m. in the Woodstock Opera House and will be preceded by a coffee hour in the community room. Brent is the founder and proprietor of one of the coun try's leading independent bookstores. The stores has long been a fixture on North Michigan. Avenue in Chicago and has served as a gathering place for authors. The Creative Living Series will continue in March with E. Leland Weber, former president of the Field Museum of Natural History and will conclude in April with syndicated cartoonist Nicole Hollander.
