• Wheels SMART MONtY Bruce Williams Neighbors reclaim driveway By Brace Williams DEAR BRUCE -- We have liyed in our home for 35 years and share a common driveway with our neighbor on the left. There is nothing in our deed that refers to the driveway, since it was there when we bought the house, and one family built both hous­ es before World War II. The house next door was recently sold, and the new owner says we may no longer use the driveway. He claims that we have no rights to it and says we will have to cut a new driveway through our "own proper­ ty." Since the driveway is over 300 feet long, this would be a huge expense, and we really cannot afford to spend the money. For 35 years, the old arrangement worked perfectly, and we see no reason why it can't contin­ ue. But the neighbors are adamant. We are not allowed on the driveway and they block it with one of their cars. Can they do this to us? -- D.L., GREENVILLE, SC. DEAR BRUCE - We drive, or I should say, drove, a relatively old (1967) automobile. But it was in excellent condition and had very low mileage. One of our neighbors very careless­ ly backed out of his driveway at a Ugh rate of speed and demolished our car, which was legally parked in front of our home. The neighbor is very sorry and is turning the matter over to his insur­ ance company. The problem is that the insurance company says the car was only worth a few hundred dollars, even though it will cost almost $3,000 to have it repaired. We liked the car and it was provid­ ing excellent transportation for us. And there's no way we are going to find another one like it for the $275 the insurance company has offered us. Where do we go from here? -- I.P., HUTCHINSON, KAN. DEAR IP. -- Unfortunately, you're up against a very hard fact of life. The car may be worth thousands Up you, but it is only worth a couple of hundred dollars on the open market, and insurance companies pay open- market rates. This kind of thing happens all the time when an old automobile or truck is wrecked and the cost of repairing it far exceeds its practical (or market) value. Unhappily, I suspect that were you to go to court with a matter of this kind, you would wind up receiving no more than the insurance company has offered. You might even receive less. DEAR BRUCE - Last month, I bought a brand-new '85 luxury auto­ mobile. When I brought the car home, I noticed a strong gas smell and dis­ covered that the gas tank leaked. I im­ mediately returned the car to the deal­ er after a holiday weekend (during which the dealer was closed), and it was determined that the gas tank had a minor leak. Two days later, the dealer called and asked if I had picked up my car. When I answered that of course I hadn't, he said that the car must have been stolen. Several days later, the police recov­ ered the automobile, but the car had been severely damaged. The roof was dented, the door panels needed to be replaced, and the paint was so badly abused that the car will probably have to be repainted. That car was virtually brand-new; it had a total of 108 miles on it. It is my position that the dealer's insurance company should provide me with a new automobile. But they say no; they're going to repair the original car. I can't bear the idea of paying full price and ending up with a badly dam­ aged automobile. If you were faced with this problem, how would you han­ dle it? - J.L., OMAHA, NEB. DEAR J.L. -- I'm with you. There's no way that I would accept that auto­ mobile repaired. A car with 100 miles on it is not vir­ tually brand-new, it is brand-new. And you are, in my opinion, entitled to a brand-new replacement. In the event that their insurance company refuses to see it that way, I would not accept the original automo­ bile but would immediately see an at­ torney and take the dealer to court. It's hard to believe that any judge or jury would see the matter any differ­ ently from the way both of us view it. DEAR BRUCE -- My husband and I are looking for a used car. We have seen advertisements from some of the major rental companies advising that they are selling some of their late- model rental automobiles. The prices seem attractive and the guarantees make the deal sound even more enticing. Would you recommend that we purchase one of these cars7 -- C.L., HANOVER, N.H. DEAR C.L. -- There are some plus­ es and minuses in this kind of used- automobile transaction. On the minus side, you are buying a car that has been driven by dozens, possibly hundreds, of different driv­ ers. This is considerably harder on an automobile than having one or two drivers. On the plus side, most major rental car companies take excellent care of their automobiles, recognize the value of preventative maintenance and of­ fer cars that are in excellent condition for resale. And you have already pointed out an additional plus. Major rental compa­ nies offer good prices and decent guarantees. I would have no reservations about purchasing one. But as with any used automobile, I would buy it on the con­ dition that it could be inspected by the mechanic of my choice and that the sale would be voided (or not consum­ mated) in the event that the mechanic rejected the car. Be certain to have your mechanic do the following: have a compression test run, check the brakes, check the transmission, check the differential, check the entire power train and give the car a general thorough mechanical inspection. If it fails at any major point, reject that car. (NEWSPAPER ENTERPRISE ASSN.) Americans support seat belts By Thomas // Hanna President and Chief Executive Officer Motor Vehicle Manufacturer Association Most Americans -- from coast to coast -- support a state law to wear safety belts. The alternative would be an air bag or an automatic belt, which would not require any action by a front seat passenger. The nationwide margin of support for belt u;«e laws was 68 percent. Eighty-four per­ cent said the lav/ should be strictly enforced and 88 per­ cent indicated that they would buckle up always or most of the time if their state had a belt use law. Admittedly, the air bag has supporters, too, but there is a question as to how much people really know about them. A relatively low percen­ tage of motorists realize that a lap belt is needed with an air bag to be effective. The air bag is effective in front end collisions but the belt is necessary when a car is hit on the side or rolls over. One of the major causes of death is ejection from the automobile, which belts help prevent. However, motor vehicle manufacturers strongly en­ dorse state laws requiring the use of safety belts--for a very good reason. The three-point belt is installed on nearly every car on the road. The cost to use them is nil, the benefits enormous in saving lives, re­ ducing injuries and elimina­ tion of billions of dollars in in­ surance claims and health care costs. Here's a point to remember. Safety belts can "go to work" now. If manufacturers began installing a passive restraint in every new car manufac­ tured right now, it would be at least 15 years before every car on the road carried one. Belt use laws are proven and have plenty of support. Groups like the American Au­ tomobile Association, many insurance companies, law en­ forcement officers, the medi­ cal community and others support belt use laws. America is the only mqjor country on this globe which does not have a law requiring all its riders to wear belts. The current number of na­ tions exceeds 30. Seven Cana­ dian provinces, including On­ tario and Quebec, require motorists to buckle up. More than a dozen states have passed belt use laws and the number is growing this year -- week by week. The snowball may already be roll­ ing It is my hope that we can pass belt laws that will save lives or prevent injuries to all Americans of all ages in even less time.
