The width of the roadway to be covered with the proposed con- crete pavement, including the inte- gral curb in that part of Winnetka Avenue within the Village of Win- netka from the northeasterly line extended from the northwest, of the right of way of the Chicago, North Shore and Milwaukee Railroad to the west line of the southeast quar- ter of Section twenty-one (21), Township forty-two (42) North, Range Thirteen (13) east, shall be fourteen (14) feet. The width of the roadway to be covered with the pronosed ron- crete pavement. including the in- tegral curbs in that part of Winnet- ka Avenue from the west line of said southeast quarter of Section twenty-one (21) and from the west line of the northeast quarter of Section twenty-eight (28) in the Township and Range aforesaid, to the east line and the east line ex- tended of the west half of the north- east quarter of Section twenty- eight (28) aforesaid shall be twen- ty-eight (28) feet, except between the proposed pavement in Woodland Avenue and the proposed pavement in Essex Road where the proposed pavement, including integral curbs, shall be thirty-nine (39) feet in width, fourteen (14) feet of which said proposed pavement shall be laid south of and adjoining the cen- ter line of Winnetka Avenue and the remaining twenty-five (25) feet of said proposed pavement shall be laid north of and adjoining the center line of Winnetka Avenue. The width of the roadway to be covered with the proposed concrete pavement, including integral curb, in that part of Winnétka Avenue within the Village of Winnetka from the cast line extended of the west half of the northeast quarter of said Section twenty-eight (28) to the southwesterly line extended from the northwest of Sheridan Road shall be fourteen (14) feet. The width of the Roadwav to he covered with the proposed concrete pavement, including integral curbs, in Woodland.Avenue shall be nine- teen (19)feet, except from the pro- posed pavement in Winnetka Ave- nue to the south line of Remy Park Subdivision where the proposed pavement, including integral curbs, shall be twentv-seven (27) feet six (6) inches in width, nine (9) feet six (6) inches of which said proposed pavement shall be laid west of and adjoining the center line of Wood- land Avenue and the remaining eighteen (18) feet of said pronosed pavement shall be laid east of and adjoining the center line of Wood- land Avenue. The width of the roadway to be covered with the proposed concrete pavement. including integral curbs, in Essex Road shall be nineteen (19) feet except from the proposed pave- ment in Winnetka Avenue to the south line of Remy Park Subdivi- sion where the proposed pavement, including integral curbs, shall be twenty-seven (27) feet six (6) inch- es in width, nine (9) feet six (6) inches of which said proposed pavement shall be laid east of and adjoining the center line of KEssex Road and the remaining eighteen (18) feet of said pronosed pavement shall be, laid west of and adjoining the center line of Essex Road. The width of the roadway to be covered with the proposed concrete navement, 'including integral curbs. in Ponlar Street shall be twenty- four (24) feet. The roadway at curb corners shall be widened along curved lines; the radius of the curb corner at the northeast corner of Woodland Ave- nue and Winnetka Avenue shall be ten (10) feet; the radius of the curb corner at the northwest cor- ner of Essex Road and Winnetka Avenue shall be ten (10) feet; the radius of the curb corner at the southwest corner of Essex Road and Elder Lane shall be sixty (60) feet; the radius of the curb corner at the southwest corner of Haw- thorn Lane and Fairview Avenue shall be twelve (12) feet; the radius of the curb corner at the northeast cor~»r of Wilson Street and Win- netka Avenue shall be sixty (60) feet: the radii of the curb corners at Bertling Lane and Winnetka Avenue shall be thirty (30) feet; the radius of the easterly curb of the roadway herein proposed to be con- structed at the west end of the most westerly Public Park in the Remy Park Subdivision shall be thirty- seven (37) feet six (6) inches; the radius of the westerly curb of the roadway herein proposed to be con- structed at the east end of the most easterly Public Park in the Remy Park Subdivision shall be thirty- seven (37) feet six (6) inches; the radius of the most easterly curb at the east end of the pavement here- in proposed to be constructed at the east end of Sunset Road in the Remy Park Subdivision shall be fifty-six (56) feet six (6) inches; the radii of the reverse curves where the two branches of the pave- ment herein proposed to be con- structed in Sunset Road in Teruy Park Subdivision rierge into the single pavement herein proposed to be constructed at the west line of said Remy Park Subdivision shall be fifty-six (56) feet six (6)inches; the radii of all other curb corners shall be twenty-five (25) feet. The roadways of all street returns to be covered with the concrete pave- ment shall be of the same width as the present pavements which con- nect with said street returns, and the width of all other roadways, in- cluding integral curbs, herein pro- posed to be constructed shall be nineteen (19) feet; all in the Village of Winnetka, County of Cook and 'State of Illinois, and which said ordinance was duly passed by the Council of the Village of Winnetka 5 the nineteenth day of February, The Council of the Village of Win- netka do ordain: SECTION 1. WHEREAS heretofore, on to-wit, the 5th day of February, 1918, the Board of Local Improvements of the Village of Winnetka submitted and recommended to the Council of the Village of Winnetka an ordinance which provided for the construction of a local improvement in said Village, as follows, to-wit: For the improve- ment of Walnut Street from the pres- ent pavement in Willow Street to the pavement herein proposed to be con- structed in Hawthorn Lane; Poplar Street from the present pavement in Oak Street to the present pavement in Cherry Street; also Poplar Street from the present pavement in Cherry Street to the present pavement in Ash Street; also Poplar Street from the present pavement in Ash Street to the present pavement in Willow Street; also Pop- lar Street from the present pavement in Willow Street to the present pave- ment in Wilson Street; Myrtle Street from the present pavement in Willow Street to the pavement herein propos- ed to be constructed in Hill road; also Sunset Road in said Remy Park Subdivision from the west line of said Subdivision easterly and northeasterly along curved lines to a point north of and opposite the east end of the curved line bounding the northwesterly portion of the pub- lic park in said Subdivision lying west of Woodland Avenue, thence east in a line and said straight line extended bounding the north side of the several public parks in said Subdivision to a point north of and opposite the west end of the curved line bounding the easterly portion of the public park in said Subdivision lying east of Essex Road, thence easterly, southerly and westerly parallel with the said curved line bounding the easterly end of said last mentioned public park to a point south of 'and opposite the west end of said curved boundary line, thence west in a straight line parallel with the straight line and said straight line ex- tended bounding the south side of the several public parks in said Subdi- vision to a point south of and opposite the east end of the curved line bound- ing the southwesterly portion of the said Public Park lying west of Wood- land Avenue, thence northwesterly and westerly "along curved lines: to and connecting with the pavement herein- before proposed to be constructed in said Sunset Road at the west line of said Remy Park Subdivision, except the pavements herein proposed to be con- structed at the intersections of said Sunset Road with Woodland Avenue, and except the pavements herein pro- posed to be constructed at the inter- sections of said Sunset Road with Es- sex Road; Hill Road from the present pavement in Wilson Street to the pres- ent pavement at the west line of Trier Center Neighborhood Subdivision; that portion of Winnetka Avenue within the Village of Winnetka from the northeasterly line extended from the northwest of the right of way of the Chicago, North Shore and Milwaukee Railroad to the west line of the south- east quarter of Section Twenty-one (21), Township Forty-two (42) North, Range Thirteen (13) East; also Win- netka Avenue from the said west line of the southeast quarter of Section Twenty-one (21) and from the west line of the northeast quarter of Sec- tion Twenty-eight (28), Township and Range aforesaid, to the east line and the east line extended of the west half of the said northeast quarter of Sec- tion Twenty-eight (28) aforesaid; also that part of Winnetka Avenue within the Village of Winnetka from the east line extended of said west half of the northeast quarter of Section Twenty- eight (28) aforesaid to the south- westerly line extended from the north- west of Sheridan Road; Bertling Lane from the pavement herein proposed to be constructed in Winnetka Avenue to and connecting with the present pave- ment in said Bertling Lane fifty-eight (58) feet north of and parallel with the north line extended of said Win- netka Avenue; also the street returns of Winnetka Avenue at Wilson Street, Warwick Avenue, Abbottsford Road, and that portion of the south street return of said Winnetka Avenue at Tissex Road within the Village of Win- netka, as far Back as the strect line of Winnetka Avenue extended, by ad- justing present manhole covers, adjust- ing present catchbasin covers, adjusting present concrete sidewalk approaches, resetting present fire hydrants, reset- ting present electric light poles, furn- ishing and setting new cast iron man- 'hole covers and cast iron catchbasin covers, constructing brick masonry straight line parallel with the straight valve vaults, constructing new con- crete sidewalk approaches, construct- ing vitrified salt glazed tile road drains and connections, constructing brick masonry manholes with cast iron cov- ers, constructing brick masonry com- bination manholes and catchbasins with cast iron covers, constructing brick masonry catchbasins with cast iron covers, constructing cast iron sewer inlets each on a concrete base, refilling tile road drain trenches under proposed pavements with sand, refilling all other tile road drain trenches in said proposed improvement with equal parts cinders and earth, excavating, grading and preparing the subgrade to receive the proposed pavement, grad- ing and leveling the parkways, grub- bing, removing all surplus excavated materials and paving with a one (1) course reinforced Portland cement concrete pavement with integral curbs, with asphaltic - felt filled joints, in- cluding a two (2) inch earth covering upon said pavement, the wetting and cleaning of the said concrete wearing surface of said proposed pavement, in- eluding all labor and material, and engineering and supervision during the construction of the said proposed im- provement. The width of the roadway to be covered with the propesed concrete pavement, including the integral curb in that part of Winnetka Avenue with- in the Village of Winnetka from the northeasterly line extended from the northwest, of the right of way of the Chicago, North Shore and Milwaukee Railroad to the west line of the south- east quartet of Section Twenty-one (21), Township Forty-two (42) North, Range Thirteen (13) East, shall be fourteen (14) feet. The width of the roadway to be cov- ered with the proposed concrete pave- 'ment, including the integral curbs in that part of Winnetka Avenue from the west line of said southeast quarter of Section Twenty-one (21) and from the west line of the northeast quarter of Section twenty-eight (28) in the Township and Range aforesaid, to the east line and the east line extended of the west half of the northeast quarter of Section Twenty-eight (28) aforesaid shall be twenty-eight (28) feet, ex- cept between the proposed pavement in Woodland Avenue and the proposed pavement in Essex Road where the pro- posed pavement, including integral curbs, shall be thirty-nine (39) feet in width, fourteen (14) feet of which said proposed pavement shall be laid south of and adjoining the center line of Winnetka Avenue and the remaining twenty-five (25) feet of said proposed pavement shall be laid north of and adjoining the center line of Winnetka Avenue. y The width of the roadway to be cov- ered with the proposed concrete pave- ment, including integral curb, in that part of Winnetka Avenue within the Village of Winnetka from the east line extended of the west half of the north- east quarter of said Section Twenty- eight (28) to the southwesterly line extended from the northwest of Sher- idan Road shall be fourteen (14) feet. The width of the roadway to be cov- red with the proposed concrete pave- ment. ineluding integral curbs, in Woodland Avenue shall be nineteen (19) feet, except from the proposed pavement in Winnetka Avenue to the south line of Remy Park Subdivision where the proposed pavement, includ- ing integral curbs, shall be twenty- seven (27) feet six (6) inches in width, nine (9) feet six (6) inches of which said proposed pavement shall be laid west of and adjoining the center line ~f Woodland Avenue and the remain- ing eighteen (18) feet of said proposed pavement shall be laid east of and ad- inining the center line of Woodland Avenue. The width of the roadway to be cov- ered with the proposed concrete pave- ment, including integral curbs, in Es- sex Road shall be nineteen (19) feet except from the proposed pavement in Winnetka Avenue to the south line of Remy Park Subdivision where the pro- posed pavement, including integral curbs. shall be twenty-seven (27) .feet six (6) inches in width, nine (9) feet six (6) inches of which said proposed pavement shall be laid east of and ad- joining the center line of Essex Road and the remaining eighteen (18) feet of said proposed pavement shall be laid weat of and adjoining the center line of Essex Road. The width of the roadway to be cov- ered with the proposed concrete pave- ment, including integral curbs, in Pon- lar Street shall be twenty-four (24) feet. The roadways of all street returns to be covered with the concrete pavement shall be of the same width as the present pavements which connect with said street returns, and the width of all other roadways 'neluding integral curbs, herein pro- posed to be constructed shall be nine- teen. (19) feet; together with an es- timate of the cost thereof amounting to Two Hundred Six Thousand, eight hundred six Dollars ($206,806.00), which said ordinance and estimate were, on the said nineteenth day of February, 1918, duly passed and approved by the said Council of said Village, and WHEREAS thereafter, in accordance with said ordinance, a petition was duly filed in the Superior Court of Cook County, Iilinois, bearing Docket Number 235,942 in said court, prayine that steps be taken to levy a special assessment for the purpose of paying the cost of said improvement, and such proceedings were thereafter had in said cause as resulted in judgments of confirmation amounting to One Hun- dred Ninety Thousand four Hundred and 20/100 Dollars ($190,400.20) and WHEREAS thereafter, the Board of Local Improvements of the Village of Winnetka duly called a public hearing, an Act of the General Assembly of the State of Illinois entitled "An Act Con- cerning Local Improvements" approv- ed June 14, A. D. 1897, and all amend- ments thereto, for the purpose of as- certaining the views of the property owners interested upon the question of the award of a contract for the con- struction of said improvement for an amount in excess of the amount for which the original assessment for said improvement was confirmed; and it appearing, as the result of a vote of the property owners attending said public hearing, that a majority there- of were in favor of awarding said contract for the ameunt of the lowest regular bid of a responsible bidder, to- wit: the sum of Two Hundred twenty eight Thousand nine = hundred fifty- seven Dollars ($228,957.00), a resolu- tion was duly passed by the said Board of T.ocal Improvements, at the said public hearing, awarding a contract for the making of said improvement in accordance with the terms of said ordinance, at a cost of Two Hundred twenty-eight Thousand nine hundred fifty-seven Dollars ($228,957.00), which said sum the contractor, or its assigns, are entitled to receive, as provided for in said contract, together with Three Thousand one hundred nineteen and 80/100 Dollars ($3,119.80) which it is estimated will be required to pay the accruing interest thereon, aggregat- ing the sum of Two Hundred thirty- two Thousand séventy-six and 80/100 Dollars ($232.076.80), and . D. 1897, and all amend- ments thereto, and that of the amount of said assessment to be collected as aforesaid. the sum of Two Thousand five hundred and 59/100 Dollars ($°.- 500.59), which sum does not exceed six (6) per centum of the amount of said Supplemental Special Assessment, shall be applied so far as may be required to the payment of all lawful exnenses attending the proceedings for making the proposed Supnlemental Special As- sessment, including court costs and cost of making, levying and collect- ing said Supplemental Special Assess- ment, in accordance with the provi- sions of said Act and the amendments thereto. ' SECTION 4, That the aggregate amount herein ordered to be assessed and also the assessment against each lot or parcel of land assessed shall be divided into and shall be payable and collectible in ten (10) installments. in the manner provided by the said Act, and each of said installments shall bear interest at the rate of five (5) per cent per annum until paid.
