On the advice of my legal counsel, I refrained from disclosing any of the material facts until this matter was judicially resolved. I did, however, unequivocally state that the allegations were completely false, frivolous, and that in due course my name would be cleared. I am pleased to report that the charges have been withdrawn and, as promised, I am finally able to tell my side of the story. In May, 2007, the basement apartment at my family home was rented to a female tenant, who happened to be Street's girlfriend. Street was often at the residence and it quickly became apparent that the two had a very volatile relationship marred by domestic violence. On June 9, 2007, less than a month from when the tenancy commenced, we heard screams coming from the basement. The tenant was obviously in distress and she screamed for our assistance. Given the apparent urgency, we entered the apartment to find toppled furniture, broken glass, and blood on both Street and his girlfriend. In her irate state, the tenant revealed that Street was cultivating marijuana in the basement apartment. After viewing the plants, I realized that the matter was rapidly getting out of hand and I called the police. Before the police arrived, both the tenant and Street fled the apartment. Later that night, we received a phone call from the tenant's family revealing that she had been arrested for unrelated charges and that the family would come at a later date to move out her belongings. The apartment was locked and sealed, but when we returned the next day, much to our surprise, we found Street sleeping in the apartment. He explained that his girlfriend would often lock him out so he had rigged the basement window to allow him access. I instructed Street to vacate the premises immediately or I would once again call the police. He said that he would pack up some of his belongings and be gone by the next day. The following day, however, his tone had changed considerably; this time he wanted money in return for him leaving. It was obvious that Street was not going to leave willingly, so I called the police. When the police arrived, Street alleged that I had pushed him. The police advised that I should let Street back into the unit and have him formally evicted through the Landlord Tenancy Board. I reluctantly allowed Street to enter the apartment and when I went to serve him with Notice of Termination, he called the police and repeated the allegation of being pushed. At this point the police charged me with two counts of assault, but Street continued to live in the rental unit. Subsequently, the Landlord and Tenant Board determined that Street was not a tenant and that he had committed an illegal act "involving the production and possession of an illegal drug in the rental unit," and ordered him to vacate the premises. Street refused to abide by this Order and was eventually removed with the assistance of the Sheriff. Shortly after this incident, it was reported in the papers that Street was arrested as a part of a massive street crime ring. He, along with 19 others, faced a total of 64 theft related charges from over 200 thefts with estimated losses over $100,000. On April 11, 2008, the Crown withdrew the charges on the understanding that there was no admission of any guilt or wrongdoing on my part. In fact, the Crown articulated that this was "rightly so." In return for withdrawing the charges, the Crown asked whether I would agree to a peace bond stipulating that I have no contact with Street for six months. I have no reason to associate with Street. This resolution was acceptable and I had no reason not to accept such conditions. Although this has been a very difficult ordeal, I was comforted by the unimaginable support that I received from the community. To some degree, I expected to receive support from those who could attest to my character, but I was overwhelmed by the support that I received from complete strangers. I am fortunate that I live in a sophisticated community that appreciates that frivolous allegations do not trump the presumption of innocence.
