Public board can't hire who it wants to teach by Ian Holroyd Special to the Beaver 9 | Wednesday, September 25, 2013 | OAKVILLE BEAVER | www.insideHALTON.com Principals cannot hire the best teacher for the job under hiring practice regulations imposed by Ontario's Ministry of Education, says the Halton District School Board (HDSB). So, the board has embarked on a campaign against Regulation 274, which, according to trustees, places a greater emphasis on hiring based on seniority rather than on the best fit for individual classrooms. According to the Ontario Principals' Council (OPC), Regulation 274 was originally introduced to address claims of nepotism and favouritism when hiring teachers. The regulation has faced resistance from teachers and school boards alike since its inception Sept. 12, 2012. At a Sept. 18 board meeting, trustees voted unanimously for HDSB Director of Education David Euale to officially ask Minister of Education Liz Sandals to rescind the regulation. The board also resolved to write a letter to the Toronto District School Board and the OPC as a show of support for their respective efforts combatting the regulation. The board's communication department was also directed to produce a media release regarding the regulation and its consequences. Oakville Ward 5 and 6 trustee Kelly Amos introduced the motion following a presentation from Debra McFadden, executive officer of human resources at HDSB, outlining the regulation and its effect on students. "Seniority hiring does not take into account the specific or unique needs of individual schools," Amos said, reading from a prepared statement. "There are many more qualities that are essential in the selection of a teacher than their broad qualifications and their seniority. "Each community is different, which creates the culture of the school and there may be specific needs in hiring due to the ethnicity of the community, which are not addressed in the regulations," she continued. "There also may be specific qualities that are required and adhering only to qualifications will not allow for selection of the best teacher to fit the needs of the class." According to McFadden, under the regulation, the board must now interview the top five most senior Long-Term Occasional (LTO) teachers who meet the qualifications when filling a position. If no one from the first group accepts the position, only then is the process opened up to the entire LTO list. The board can then select another group of qualified applicants and make an offer. If no one from the second group accepts the job, the board can then seek to hire externally. "Principals must be able to assess other additional qualifications, make up of the current school, staff and filling any gaps that may exist and other needs inherent in each local school," said Amos. McFadden noted during her presentation, based on HDSB's timeline for hiring and the volume of jobs they are required to fill, it is impossible for the board to follow the regulation to the letter. "A growing board of our size simply can not comply with the regulation as it's written," McFadden said. Amos agreed saying "It is a regulation that was written for non-growth boards and without the understanding of staffing timelines."
