www.insideHALTON.com | OAKVILLE BEAVER | Friday, February 14, 2014 | 8 Council rejects four-storey apartment plan near Kerr Village Oakville Town Council has rejected a plan to build a four-storey apartment building with ground-floor retail on Lakeshore Road West near Kerr Village. Planning and Development Council unanimously followed the lead of Ward 2 Town and Regional Councillor Cathy Duddeck earlier this week in rejecting the project proposed for 174 Lakeshore Rd. W. and 91 and 87 Brookfield Rd. Duddeck said the plan would be over-development of the properties and incompatible with the surrounding residential neighbourhood. The applicant, 822403 Ontario Inc., sought a rezoning to allow the building that was to face onto Lakeshore Road West and contain 37 apartments and 86 underground parking spaces. Johnston Litavski Planning Consultants partner Paul Johnston, speaking for the applicant, said his client has worked tirelessly over the last year with the Town and residents to address concerns. He said four townhouse units were removed from the plan and setbacks from adjacent properties increased on two sides of the building. He asked council to follow recommendations put forward by Town staff. But residents don't feel the changes go far enough to fit character of the neighbourhood, said WeirFoulds lawyer Denise Baker, speaking on behalf of area residents. She said the proposed building would tower over adjacent properties, the density is too high and the shadow the building would cast on neighbouring homes would negatively impact the residents. Baker charged, the developer is trying to over build the land. "The residents aren't in anyway anti-development with respect to this site. This is not a situation of `not in my backyard.' This is not a situation of `we don't want an apartment building'," she told councillors. "This is a situation where there needs to be a development that is appropriate and compatible with the existing stable residential neighbourhood." Johnston argued, there are three-, four- and even five-storey buildings within blocks of it. Duddeck, said while residents know development occurs, they want it to fit appropriately within the place they call home. "Remember, they are not a neighbourhood that has been silent through our various planning process," she said. "They've been an active, engaged community willing to give their time, effort and even money to ensure that any development in the area is in keeping with their vision of the area."
