If you have a spouse and no children, your spouse is entitled to your entire estate. Common law spouses are not included in the definition of `spouse' and therefore are not entitled to any of your estate. If you have a spouse and biological/ adopted children, your spouse gets the first $200,000 and ½ of the balance if you have one child or 1/3rd if you have more, with the remainder going to your children. If you aren't married, the order goes children (and down the line), parents, brothers and sisters, and then nephews and nieces. Any inheritance payable to a minor must be paid into Court and the minor will receive the remainder at age 18.
