NEWS 11 Juror collapses as pathologist describes woman's death during murder trial DAVID LEA dlea@oakvillebeaver.com A juror has been ex­ cused from the second-de­ gree murder trial of Ryan Porte after apparently fainting as a pathologist testified about the details of Judith Wilson's death. Porte, 41, is accused of strangling his mother, Wil­ son, 63, to death at her Shel­ don Avenue home on Sept. 21, 2015. He has pleaded not guilty. He has pleaded not guilty. The fourth day of the tri­ al, Jan. 22, saw Crown at­ torney Laurie Jago call fo­ rensic pathologist Dr. Re- bekah Jacques to the stand. Jacques preformed Wil­ son's autopsy and conclud­ ed the retired Town of Oak­ ville employee died as a re­ sult of neck compression. She noted the force ap­ plied was great enough to break the hyoid bone, thy­ roid cartilage and cricoid cartilage in Wilson's neck. Jacques also made note of various bruises on Wil­ son's body. This included a pro­ nounced left black eye and other bruises and abra­ sions on the left side of Wil­ son's face. Other bruises were found on Wilson's hands, arm, neck and legs. Wilson's upper jaw was also fractured. Jacques testified these bruises and abrasions were the result of blunt force trauma. When asked by Jago if a fist could have made the bruises Jacques noted it was possible. Jacques also said the bruises on the back of Wil­ son's hands could be defen­ sive wounds. Under cross examina­ tion by defence attorney Brendan Neil, Jacques ac­ knowledged it was also pos­ sible the bruises could have come from some kind of fall. When asked by Neil if the bruises on Wilson's hands could have come from her striking some­ thing or someone Jacques said it was possible. In a 911 call made from 1343 Sheldon Ave., the night of Wilson's death, a caller who identified himself as Ryan Porte alleged his mother had tried to assault him and he had strangled her. During her testimony Jacques referred to both crime scene and autopsy photos, which showed Wil­ son's body. Porte could be seen wip­ ing away tears as Jacques pointed out Wilson's inju­ ries in these photos. He gasped and briefly turned away when a close- up of Wilson's severely bruised face was shown. It was also during this period that juror No. 9 ap­ peared to lose conscious­ ness, slumping forward in his chair. Halton police attended the court and attempted to revive the older man who was unresponsive for sev­ eral seconds. The juror could eventu­ ally be seen opening his eyes at which point he be­ gan to answer the officer's questions. The trial recessed for around 45 minutes after which the juror walked in­ to the courtroom on his own and Justice Gisele Miller granted the individ- ual's request to be excused from the rest of the trial. The trial will continue with the remaining 11 ju­ rors. Jacques's testimony marked the conclusion of the Crown's case. Jago finished the day by reading an agreed state­ ment of facts into the re­ cord. Among the admissions in this statement is that neither side contests that on Sept. 21, 2015 Ryan Porte caused the death of Judith Wilson by strangling her. The defence was set to begin presenting its case on Tuesday, Jan. 23.
