Scott Elsbury has oper- ated SE Auto Sales and Ser- vice for approximately 26 years, with the business housed at 1502 Speers Rd. for the last 11 years. He said issues with the Town started in late 2016 when he and a number of other businesses in the ar- ea were asked to vacate a section of Town-owned land, which stretched about 15-feet in from the sidewalk for the widening of Speers Road. "The mechanical shop at that time was at the front of the building. You would have to pull into the front of the building to be able to get cars into the garage so my guys could service them. By having to move back I could no longer do that," said Elsbury. "There is another shop in the back of this same ad- dress - I had to rent that shop, kick a tenant out and move all my equipment in- to that shop, which cost me something in the area of $25,000." Jim Barry, the Town's director of municipal en- forcement services, said the municipality started contacting property own- ers in 2015, advising them to prepare for road widen- ing and reduced boulevard space. He also said property owner co-operation was sought to remove any en- croachments on the munic- ipal boulevard, which are not allowed under Town bylaws. Elsbury argues so far all his expensive preparations have been for nothing, since construction work has not even begun to wid- en his section of Speers Road. Elsbury said he eventu- ally began to park vehicles at the bottom of the lot again. He said when represen- tatives from the Town re- cently visited the property he asked them if what he was doing was OK. He said they told him it was fine. "We crept back up, but we certainly weren't any- where near the sidewalk. We were well back from where we used to be," said Elsbury. "And then I came in on July 9 to find $550 worth of parking tickets on my cars." He said at 10 a.m. that morning he received a call from the Town telling him "the tow trucks are on their way" and to move the vehi- cles. "The Region and the Town of Oakville both talk about how they want to help small business and they want to attract this kind of stuff and they want to help small business peo- ple especially in this corri- dor prosper ... This doesn't help me prosper," said Els- bury. "Handing me $550 worth of tickets takes food from my mouth." The Oakville business- person wants the Town to tear up those tickets and permit him to use the land until the road widening ac- tually comes. He said all he wants to do is park cars there, which can be moved at a mo- ment's notice. While Barry would not comment specifically on Elsbury's tickets he noted that since 2015 most of the encroachments to the mu- nicipal boulevard in this area have been removed.
