The Oakville municipal election may be over, how- ever, a challenge concern- ing the validity of the Ward 7 elections appears to be just getting started. The races in Ward 7 were particularly close. The election race for Ward 7 town and regional councillor ended with BDO Canada LLP consultant Pa- van Parmar coming out on top with 570 votes, followed by local entrepreneur Shahrez Daniyal Hayder with 502 votes, health care executive Nav Nanda with 491 votes, software consul- tant Amir Henry with 371 votes and financial profes- sional Shahab Khan with 108 votes. The Ward 7 town coun- cillor race was closer still with lawyer Jasvinder Sandhu elected with 551 votes, Realtor Saima Zaidi getting 532 votes, Adrian Paris receiving 455 votes and Ajay Rosha receiving 420 votes. With Sandhu and Par- mar's swearing-in to Oak- ville council still a recent memory, Hayder's family has hired a lawyer and filed an application with the On- tario Superior Court of Justice, which among oth- er things calls on the court to issue an order determin- ing that the Ward 7 elec- tions were not valid and that a byelection should be held. A hearing will be held in Milton court on Feb. 14 to address the matter. The application says the grounds for requesting the Ward 7 elections be invali- The application states this information is key to determining whether any voting irregularities took place and if so, how wide- spread they were. Oakville Mayor Rob Burton has declined to comment on the matter, stating it is before the courts. The town's director of strategy, policy and com- munications, Jane Courte- manche, said the town will be responding to the appli- dated include alleged er- rors made in which Ward 6 voting cards were sent to Ward 7 voters. Allegations are also made in the application that people voted in the Ward 7 election who did not actually live in the ward. The application lists a few names and addresses of these alleged individu- als. It also argues that in the event just 19 votes or more were impacted by the is- sues or alleged issues de- scribed, the Ward 7 town councillor election should be ruled invalid as the out- come of the election would have been impacted. None of the allegations have been proven in court. For the Ward 7 town and regional councillor race that threshold is set at 68 or more impacted votes. "This isn't about me not winning. This is about the culture of Oakville and how democracy should be," said Hayder. Hayder is asking the Su- perior Court of Justice for a court order that will com- pel the Town of Oakville to disclose the voters' list and various other documents and communications con- cerning the Ward 7 elec- tion. cation at the court hearing on Feb. 14. Parmar declined to comment because the mat- ter is before the courts. Sandhu said her cam- paign was run in full com- pliance with all laws.
