Legislature thus recreant to popular rights. By the abolition of Separat» Schools, even if that could bs brought about, they would not have the !toman Catholic childron going with their lProtesiant uneighbors to schools, but they would have a voluntary tax placed upen the Roman Catholic ratcpayers to sustain Separate Schools as was done in the United States. He followed Mr. Mcredith in the legal argument of the ase to show that so far as thi@ Legislature was concerned the British North America Act deprived it of all powers to make these changes. Ho demanded to know where the line of public control should be drawn, and pointed out that in the amend-- ment of the bon.member the words "except ro-- ligious instruction" were put in, being added in writing to the type--written copy, showing that even Mrc. Meredith recognised the dificulty. HMe --would not attempt to draw that line, but would leave it to the courts to interpret the law. He moved in amendment to the amendment to refer the bill back to add theso words as a see-- tion of the bill :-- * Except as provided in sections 5 and 7 of this act nothing in this act contained ; shall be decmed, taken or construed as in any manner, or for any purpose alter-- ing, varying or affecting any power, risrl_xt. or authority which before the passing of this act was by law vested in or held, had or pos-- sessed by tho Minister of Education or the De-- partment of Education in respect either of Roman Catholic separate Schools or of any matter or thing whatsoever lpcrtnininz to or ailfecting said sSeparate Schools." Mr. Meredith in a short speech contonded that the amendment to the amendment was unsatisfactory and that he should have no hesitation in voting against it. s I Mr. Mowat spoke brietly on the question, . showing that the amendment to the amend-- ment deciared in the most spccitic mr.nm,-rl that the control of Separate Schools by the department and the Government was {o ro-- | main exaclly as it was made under the organic ' law of the Sepzrate Schools. y The vote on the amendment to the amend:-- ment resulted in 52 yeas, 31 nays, as follows :-- Division List. f YEas--Allan, Awroy, Balfour, Baxter, Big-- gar, Bishop, Blezard, Caidwell, Carpenter, Charlton, Chisholm, Clarke (Wellington), Clo-- land, Conmee, Dack, Davis, Dowling, Dryden, Ferguson, Field, Fraser, Garrow, Gibson (Ham-- ilton), Gibson (Huron), Gilmour, Guthrie, Har-- court, Hardy, Locknart, Loughrin, McKay (Ox-- ford), McKkay (Victoria), MeKechniec, McKen-- zie, M., Mack, Mackenzie, C., Moore, Mowat, O'Con.--or, Paton, Porter, -- Raysicde, -- Ross, Sharpe, Smith (York), Snider, Sprague, Strat-- ton, Tait, Waters.
