The South Marysburgh Mirror August 2023 /11 COUNCIL CORNER John Hirsch Councillor, Ward 9 South Marysburgh July - Finally out of the shadows on Picton Terminals We finally completed the process of considering whether a satisfactory settlement of the dispute with Picton Terminals could be reached without going to court. In the end, it was not possible to come to an agreement which would embody the restrictions Council voted unanimously for in 2021. So, there was nothing for Council to bring to public for discussion and the County’s application for an injunction in the Superior Court will proceed. Our application seeks the Court’s confirmation of our posi- tion that provincial and municipal laws, especially concerning land use planning, apply to the Picton Terminals property. Pic- ton Terminals had asserted that as a port they were exempt from the application of provincial and municipal laws. Hence they believed they could expand their operation and operate a container ship port without the need for approvals and per- mits. We disagree and expect to succeed in the court applica- tion. We will also continue appropriate enforcement action if and when Picton Terminals violates the terms of our bylaws.
