10/ July 2024 The South Marysburgh Mirror COUNCIL John Hirsch Councillor, Ward 9 South Marysburgh June - a month of decisions Council took two important decisions this month that bear mentioning in more detail. Picton Terminals Council filed an application in provincial court in 2022 to assert our right to apply the Planning Act and municipal zoning bylaws to the Picton Terminals property. They had claimed we don’t have such rights. After much back and forth a proposal to try to reach a settlement rather than pursue the court case was put for- ward. On June 25 Council decided as follows: e That Council approve the draft terms of settlement and direct legal counsel to seek similar approval from Picton terminals. That a meeting with Council, the Mohawks of the Bay of Quinte and Picton Terminals be held to discuss the draft terms of settlement at the earliest opportunity prior to bringing a bylaw to implement the settlement agree- ment and That the executed minutes of settlement be made pub- lic with the applicable Council agenda Vote was recorded — For: Harrison, Braney, Grosso, Nieman, Roberts, Pen- nell, Engelsdorfer Against: Hirsch, MacNaughton, Maynard, Prinsen, St. Jean, Ferguson | can’t go into details due to our code of conduct pro- hibiting releasing details of what goes on in closed session. What I can say is that part of my opposition to this is that the public has had no opportunity to see or comment on the proposed terms of settlement. The public has had no opportunity to weigh in on whether the County should pur- sue the court case. You won’t get to see this until after the terms have been agreed with Picton Terminals and come to Council for approval of a bylaw. So, keep your eyes open for this coming to Council in late July or August. Fawcetteville The proposal by Hilden Homes for an 85 unit subdivi- sion on an extension of Fawcett Ave. in Picton was the subject of heated debate and well organized representation by local residents. It was clear that many of the neighbourhood’s con- cerns had not been dealt with by the developer, so Council sent them back to the drawing board — an encouraging sign in my view.
