Lyding's was the first since Parliament, in April voted to retain the death penalty. Fifteen condemned men are stili on death row, awaiting decisions as to their fate. Both Prime Minister Pearson and Solicitor General Lawrence Penneli have said that from now on, each. death sentence that cornes before the Cabinet for review wiil be judged according to the circumstances. This is the way it should be. There can no longer be automaie commutation of ail sentences. After ail, the House of Commons in a free vote de- cided 143 to 112 that the death penalty for murder should remain.' To continue to commute ail sentences would be a defiance of Parliament and the wishes of the majority of representatives of 'the Canadian people. Where there is a recommendation for mercy, the Cabinet should grant commutation. But it has no right, even though the Royal prerogative of mercy rests with it, to continue the pracice followed before. The Government, as it is, has made a mockery of the law and has placed Canada's judiciary in an embarrassing position. It is ironical 'that while there is a move in Canada to abolish the death penalty, steps have beepi started in Brit- ain to restore capital punishment. It was done away with for a five-year trial period only last November. What precipitated this surprise development were the grisly Moorland murder. Two children and a 17-year-, à v outh were tortured and brutaily siain. Ian Brady, 28, was founid guilty of ail three murdÈ1ý: and his blonde mistress, Myra Hindley, 23,,of two. They re- ceivýed the new maximum penalty: life imprisonment. British newspapers insisted that imprisonment was toc, good for them; they should have been executed.
