It was also pointed out that, ev- e ry ûase. has to brr almost handled separately and that there appear- ed no single answer to cover al cases. Mr. Story outlined the new pro- posel Gift Tax which he f elt would soon be in effect. 11e out- lined some of the good features whicb included no tax on gifts between spouses and also an in- crease of exemption of up to $2,- 000 to trusts per annum provid- îng there is only one beneficiary to the trust. 11e pointed out that the tax rate where applicable was greatly increased unider the new proposed law. Under the old plan the rate started at 10% and wcnt to a maximum of 20 per cent at $1 million. Under the new plan the rate is. drastically increased beginning, at 12 per cent to a maximum of 75 per cent at only $200,000. Mr. Story asked where was it going to end. "Hard work and iniative seems to be taxed away," he said. Mr., Clift painted a similar ýstory on the Estate Tax. H1e point- ed out that the government has toý get money from somewhere and that Estate taxing did go back to the 1870s in England. Under the new bill Mr. Clift saw some advantages over the old bll. In this he pointed tô the fact that the spouse was not taxed when the estate changes from one to the other. There was also an ad- vantage with the exemption of $1,000. for each year that a child was under the age of 26 years.' Like the Gift tax the big bite came under the new proposed legisîn- tion in the increased rate. Under the old system the top rate of 54 per cent was reached at $2 million. Under the new the top rate would be 50 per cent reach- ed at, only $300,000. It was point- ed out by Mr. Clift that it was his opinion that the new 'legislation would be passed in the house. It was .also pointed out that no es- tate under aggregate net value' of $50,000 was changed tax. There is also a basic exemption of $20,- 000. Mr. Kasden outlined 'under, what1 conditions a Will 'may bc contested and also outliner the procedure that' is followed in pro- bating a Will. H1e also pointed out that under the Dependent's Relief Act a wholly dependent wife or children may contest a Will where the testator did not provide suffîciently for bis de- pendents. Also he stated that a Will can be changed under the Variation Trust Act when the;- estate is left in trust. The, spczaker pointed to the Right of Courtcsy of a husband where he had a life. interest in ail the r-eal estate and personal property of awife. Un- der certain conditions this chang- es to a degree and this change is affected by the number of child- ren who are in the family. If a husband is to share in this estate under this law he must also, el- ect to do so within the allotted time. On a question from the audi- ence Mr. C?ïgft showed that on an estate of $100,000 if left to the wif e and later turned over to the children the estate tax would hc $13,'200. If this estate 'had in the first instance been granted $50,- 000 to the wife and $50,000 to the children and later the $50,000 left to the wife went to the child- ren the tax would be $7800. How- ever Mr. Clift di d not recommend this procedure as an answer to beating the tax. The audience was inforrned that in making a Will one should be careful who they appoint as ex- ecutors of the estate. A qualified person or firm can be more quai- îfied to handie the affairg through the various channels. The f orm- ing of Limited Co. was also dis- cussed briefly and here again those present were cautionel to look into the matter first. Mr. Butt chaired the meeting..
