Mosport has been seeking to have the restrictions lifted to allow other events at the track rather than just motor car racing. Tlhe request, to a degree, is valid but to give an open door to Mosport would be possibly beyond the interests of the Township. It would appoar fromn the most recent resolution passed by Counil that they are flot at this time flot going to budge from the terms and conditions of their zoning by-law but have flot closed the door com- pletely on some rezoning for Mosport provided it is attempt- ed through the /*oper channels. This is a reasonable stand for council and one which everyone is entitled to receive. The following is the resolution passed by council on Wed- nesday of this week. WHTEREAS Doctor Fineberg, of Mosport Park and his legal advisor Mr. B. Kamin appeared by special request before this Council on Monday l6th Mrh 1970 and requested that Council assist themi by indicating theiropinion on the question as to whiethier or not previous land uses of their lands would entitie Mosport Park to be classified in any way as a non-conforming, use in regard to by-law 1653 as recently approved by the Ontario Municipal Board and to indicate to them generally Council's attitude towards the zoning of Mosport. RESOLVED that this Couincil are of the opinion thiat the question as to whether a valid non-con- forming use exists in relation to -Mosport Par-k is a ques. tion of law and Couincil do flot intend to maake any suçch decîsion as they deem this not a proper power for thom to exercise.
