But, there is a danger ti making a left-hand turn out of the Wendy's/Tlim Horton's parking lot onto Durham, Road 57 (Waverly Road) south of Baseline Road, according to Dan Hoikema, owner of the Skylight Donut outiets in Bowmanville. Further, he believes that unless political pressure from Clarington's elected officiais had flot been applied, Regional Council would neyer have approved the application by Tim Donuts Ltd. for the Durham Road 57 i/ut access. "I approached the Region i the late 1980's to see about acquirig this piece of property on which Tim Horton's and Wendy's now stands. I asked about an in/out access on Durham Road 57, and was turned down fiat," Hokema says. "I was told that permission would neyer be given for access onto Durham Road 57 at this location because it was too near Highway 401 and posed a saf ety problem. As a result of this, I neyer pursued the issue by mak- ing a formal application to the Region." Regional Councilor Larry Hannah, expresses the vîew that Mr. Hoîkema should have pressed harder and made a formai application at that time. However, Mr. Hoîkema let the matter drop, and subse- quently rented his present location on Baseline Road. In 1994, Durham Region was approached by Tim Donuts Ltd. with an offer to pu rchase the site for a Wendy's/Tim Horton's Combo outlet. They also applied for'a 'riglit-in, right- out' access onto Durham Road 57. On March 22, 1994, iri a letter to Carlo Pellarin, Development Review Branch Clartngton. from G. Ogden, Development Approvais Techniciari, Durham Region, Mr. Ogden says: "A direct access to the site from Regional Road 57 will not be permitted. .. However, this decision was followed by sev- eral public meetings between Tim Horton'ýs repre- sentatives and both Local arid Regional coundils. Mr.' Tony Prevedel, Durham Regional Works Department,,says that Mr. Hoîkema fatled to show up at these meetings. Arid, as a result of these meetings and alleged pres- sure from Clarington offi- ciaIs and Tim Horton's the ertrance and egress were approved over Regional Staff objections. "When the vote was taken it was passed with a major- lty," says Mr, Prevedel. 'They won fair and square." On July 25, 1994, a letter was sent to Lynda J. Townsend, Barrister and Solicitor for Tim Donuts Ltd. from the Regional Clerk, C.W. Lundy, A.C.M.T. which affirmed the reversal of the previous 'no access' decîsion to approval for a 'right-in, right-out' access to Regional Road 57. At this time, Tim Horton Ltd. also entered into an agreement with the Region of Durham that the 'right-in' be closed when the volume of traffic on this road reached 16,000 cars per day. Staff was to review this situation after one year of operation. Mr. Hoîkema was angry. Not as he states, froma a view of new competition, but because of his past request being unconditionally denied. "How could Tim Horton's get the application for access approved when I -was told that access to 57 below Baseline Road would neyer be allowed?"' Hoîkema queries. Something had occurred between March and July to change the Region's deci- sion. "It is my understanding that Tim Horton's threat- eried to pull out unless this access was granted," says Regional Councillor Carson Elliott. The conditions of getting 'in-out' access approval were not followed to the letter according to Councillor Lanry Hannah. "Tim Donuts Ltd. had conditions to be met before they could get access to 57. One was the installation of a 250-300 foot southerly deceleration lane: the other was the construction of a 90 metre median south of the liglits at the corner of Baseline and Regional Road 57 to preverit left i or out turns. Neither of these con- ditions were met. Yet. approval was given for 'right- in, right-out' access." Ttm Donuts Ltd. did post a letter of credît with the Region for a median should it be considered necessary in future as a safety mea- sure to prevent left in or out turns. This proposed median was challenged by Shell at a meeting held in Clarington on'October 6, 1994, as pos- ing an obstruction to their customers and want input when and if the median is built.' The Ministry of Transportation vetoed the deceleration lane as being too close to the highwvay. In October 1994 Durham Region conducted a-study of the traffic flow on Waverly Road, 200 feet south of Baseline, north of the Highway 401 ramps and concluded that in a 241-hour 1continued on page 15 This, picture was taken on Sunday at the Tim Horton's/Wendy'5s at the corner of Baseline and Durhan Road 57.
